Hmmm. Not quite so sure about that - there is a right to remove a trespass including the fence post but I am hesitant to not quite so unequivocal about saying that it can be cut off like that.

You would have a major problem trying to cut through a concrete post

What the OP can do though is remove the trespass of roots and branches and if nessecary the trunk of the tree and remove the leaning post and be very sure to return all to the neighbour
