I think treeman has advised you correctly. If there is evidence to support the argument that the tree was diseased or weakened to the extent that a responsible owner should have noticed this and done something about it, then it may be possible to recover damages through legal action.

It might be worth having a look at the fallen tree before it is removed, taking photos and samples of any rot.

alas the farmers tree surgeon has said the tree was in good health!!

Hi all,

I know hindsight is a wonderful thing, but reading back through this thread I notice that the OP was never given proper advice, i.e. don't let anyone remove the tree until you are satisfied what caused it to fall has been properly assessed, which will involve.....
