my neighbour has their washing machine emptying into a guttering soakaway is this legal?

No this is considered 'grey water' and is not to be discharged into a water course.
It may be a 'grey area' if this water goes into a soakaway pit, ask enviromental health from the LA to have a look, also the building control department. They both have statuatory powers to sort this out.

Thanks for the replys people, I will have to sort this out soon as not only is it bad for any plants etc. but smells so bad at times
