I've been noticing alot of posts here where the Party Wall Act 1996 has been used as a blunt instrument by one party or the other. So I looked for some good advice and found this;

Notice the 2 months written notice for entry to land, but also notice the detail "If consent is refused, you must build the external wall or fence wholly on your own land, at your own expense. The wall will not be a party wall, the adjoining owners will have no right of support,".

So just because you can't prove responsibility through T marks or deeds doesn't mean a wall/fence has to become an object of dispute. If you and your neighbour can't agree you can both fence/wall on your respective sides. Picture it, two walls an inbetween a rotting old fence. :-)
They cut down all the trees, put 'em in a tree museum and charged all the people just to see 'em

unfortunatly not alot of people know about the party wall act until its to late...and then you are struck with confusion as to what to do for the better and to avoid further confrontation...
