Neighbour attaching plants to my fence !

Postby Millie2525 » Mon Jul 21, 2014 5:24 pm

Hi,
I have just had a new fence put up complete with concrete posts and needless to say, it has cost an absolute fortune. My neighbour had plants attached to the old fence and the foliage was so dense that the back of the panels was covered in a green growth that I suspect wasn't doing the panels any good at all. I am anxious that she does not attach anything to either the new panels or any of the posts - am I within my rights to ask her not to ? Would it be best just to speak to her or should I put in in writing ? She can be quite difficult - the neighbour at the end of both of our gardens has also replaced his fence and she has told him that he has put it the wrong way round ( good side to his garden) and she is going to sue him............. Any advice would be appreciated please.

Firstly she is flying a kite if she thinks she can sue him for putting fence "wrong way round " cos He who pays the piper calls the tune

Same for you

Its time your neighbour learnt the hard truth

She CANNOT )-

1) attach anything whatsoever to your posts or fence or walls

2) Grow anything up up your posts fence or walls

3) paint or stain or render your fence or walls

4) allow balls etc to bev thrown/hit/kicked against your fence or walls

5) pile or lean anything whatsoever against your fence or walls

In short ITS YOUR FENCE AND YOUR PROPERTY and she must treat it with respect

If she ignores the above you can sue her for the cost of all damage done

So put the above in writing
send it recorded delivery and keep a copy

Hi Millie,

I have just had a new fence put up...
My neighbour had plants attached to the old fence...

obvious question I know, but is the new fence stood along the same line and was the old fence stood entirely on your property?

is there any mention of "party walls" or "party fences" on your title register? or her title register?

Kind regards, Mac
