Neighbour wants us to replace hedge

Postby suewain » Sat Jun 18, 2011 5:08 pm

About 20 years ago my neighbour replaced the boundary fence with a hedge. He asked our permission because it was our boundary and we agreed. He now wants us to remove the hedge and replace it with a fence at our expense. The hedge is a conifer and is beginning to die because of the dry spring. He has had a quote and reckons it will cost £2000, which we think is unreasonable but he now keeps on harassing us saying what are we going to do about it. I feel inclined to tell him to remove the hedge he planted and we will replace it as and when we feel fit with what we want to. I would like to know if we are obliged to supply a boundary fence.

You are not.

The next time he says what are you going to do about it - your answer should be "absolutely nothing!".

If he wants to replace the boundary feature then he must do so at his won cost, you are not obliged to do so nor contribute to its costs.

Just ensure that he puts the fence on the boundary and not your side of where the hedge has grown to.
I.E. the middle of where the roots are.

I suggest you mark it out with stakes, take measurements and photos PDQ.
Any comments I give here are my own opinions, for legal advise check with a qualified solicitor.
