can neighbour cut our hedge?

can neighbour cut our hedge?

Postby sheilaleat » Sat Nov 12, 2011 3:56 pm

We recently put a fence around our front garden which our neighbours took exception to. We actually put it up as they allow their children and dog to go on our open plan front garden even though we asked them not to. Originally I put a small Leylandii hedge up but they kept reversing into the baby trees and bending them so they wouldn't grow. We then decided to just put a fence up and end the situation once and for all so they wouldn't have access. After threats and police involvement with the loons who live next door to us things appeared to queit down and we thought it would be the end of it. We returned from work less than 2 weeks after putting the fence up to find it had been removed (stolen) along with the 17 Leylandii trees which we replanted on the inside of the fence!!!!!!!! The police can't prove it was them although they have spoken to them to allow them to deny any knowledge of it. Still unsure how 55ft of fencing panels and post can just dissapear without any seeing.

Anyway my dilema is what to do next! We do not want the neighbours children and dog on our garden ruining it (they are not allowed in their own back garden as their mother says they spoil it with their bikes) and we are tired of picking up after their dog. The police have told us to plant a hedge using Berberis trees which he said were as good as barbed wire but legal. I did ask him if they would just steal this as they managed to steal the fence but he says they won't be able to get near it as it is so prickly. We are having cctv installed professionally to try to catch the loons at work if anything else happens but I don't know how we can create a barrier for our garden.

If we create a hedge with Berberis (I have found a website which sells is bare root at 60/80cms) can the neighbours cut it down. If we catch them on camera doing this will they have broken a law the police can prosecute.

Sorry for long explanation but don't know what to do next.

Can you not claim on your house insurance for the fence and plants?

Your neighbour cannot touch your fence or cut anything planted your side of the boundary

It is not easy to dig up and remove that amount of fencing
someone must have seen it happen and they would have needed a truck to put the panels in

You say that all the time but clearly it isn’t true, you can touch a neighbours fence, wall plants or pretty much anything else as long as you do no damage there will be no consequences.

This topic further underlines the fact that you can do more than touch as long as you don’t get caught, you ought to consider substituting the word “Cant” with shouldn’t.

That's your answer. Once it's up and running, replace your fence.

If the cost of fence and plant are not too sgnificant won't any payout from a claim get eaten away by higher future premiums.
