Fishing and bait digging restrictions.

For years, in fact for ever really people have fished for enjoyment of Orford Island. They have also dug bait there but it isn't as good as bought bait. There is a move to stop fishing and bait digging by DEFRA but the waters are tidal and navigable and I always understood the right to fish and dig bait is a common law right which cannot be interferred with by governments. I have been told there may also be a right under Magna Carta but I am not aware of the details. Can anybody help out here please?
