Apologies - I should have made it clear, he knows he will have to pay all the costs involved.
I was trying to edit my post and reposted completely in error!

Re: Neighbour appropriated some of my garden

Update. Trespasser sent me a letter offering me £125 in full and final settlement. He doesn't seem to realize there are legalities involved. I have sent him a letter saying he can have the land if he pays all the costs involved in transferring ownership to himself. Alternatively he can move the fenc...

Re: Neighbour appropriated some of my garden

I have incontrovertible proof in the form of a Rightmove photograph from when he purchased the property in 2013 showing the fence in perfect alignment with the ones either side. If he agrees to pay the sum I have suggested to cover the Land Registry rectification fees then I will interpret that as h...

Re: Neighbour appropriated some of my garden

arborlad - I am in direct contact with the brother who owns the property. I am happy thus far with the current situation and am attempting to negotiate a reasonably amicable resolution. I accept your view is different from my own but fail to understand why you continue to criticize my stance. Differ...

You certainly do not have a "poor grasp", unlike some other contributors.

You seem to have four of them.................

Re: Neighbour appropriated some of my garden

Will do Mac. I haven't had a response to the letter to my neighbour so we will see what transpires.

I don't think any potential purchaser would run for the hills arborlad. The boundary won't be a problem once the Land Registry documentation is correct. I don't believe I have a "poor grasp" of the situation thank you!

Re: Neighbour appropriated some of my garden

I was given the info from the Land Registry Mac. No we did not discuss dimensions but I was asked about the value of the land as apparently it has to be below a certain amount for a deed of rectification to be appropriate.

Re: Neighbour appropriated some of my garden

I don't mind a fence with a couple of doglegs. Having straight fences in a property I don't even live in isn't essential for me to be content in life. Option one as a resolution would be quite sufficient. 😜

Re: Neighbour appropriated some of my garden

I'm not willing to pay a fencer arborlad. It's more complicated than just reinstating the fence where it should be. I would have to demolish the low brick wall my neighbour has built directly behind the new fence as it is smack on the correct boundary line. It will, if my neighbour agrees with optio...

Re: Neighbour appropriated some of my garden

Thank you Morgan Sweet. In that case I'm hoping £250 is sufficient to cover all the costs involved. That's if he agrees to option one!

Re: Neighbour appropriated some of my garden

Thanks Mac. I'm told option 1 requires a deed of rectification. AP1 and a TP1 forms to be submitted to the Land Registry at a cost of £40.

Re: Neighbour appropriated some of my garden

Well. After the little diversion about title plans I thought you might like to know what I have done. Sadly my legal expenses cover does not extend to trespass. So I've written to the trespasser suggesting two options on how to proceed. I have told him I am prepared to let him have the bit of land f...

Re: Neighbour appropriated some of my garden

The wall is built immediately in front of the fence Mac. The level of his garden is lower than mine, it used to be only slightly lower at that point but appears lower than before. The top of the wall is aligned with the base of the wooden bottom fence support which runs horizontally. Arborlad - It d...
