Presumably the owner of the ROW? If it's known who the owner of a property is - then surely logically it would be down to them and nothing to do with any users of any part of that property? If this is the only access to your property then the post people etc etc have to use it, these people have a right to expect safe passage to your property and if you do not maintain the passage to your property they have the right to sue for any injury they sustain. However, it may well be advisable to draft your agreement as quickly as possible, and pay a solicitor a few quid to give it a once over.
