Re: How Long can it go on for??

We too have been through this. We are now at a point of nowhere!!! They dispute; we challenged; we compromise; they threatened; we say bring it on; they go quiet. We; after 4 years of this have moved no further than nowhere really. They clearly do not want resolution. The only advantage we have seen...

Covenants

Could anyone tell me? Your covenant states that all shared fencing to be repaired or replaced. Your neighbour removes old shared fencing. 6 foot only remains because he cant get to it. They then state that your hedge is the boundary and is enough to be ' a secure and pleasing aspect of the gardens'....

Re: My neighbour has replaced fence without my consent

It really gets my goat when advise is 'whats your problem'. No matter it is a shared fence; the fact they replace it to their liking and not yours is massive. Also, you may not touch the fence as it is deemed theirs is another purposely unneighbourly thing! I get so upset sometimes on this site when...

Home made wind turbine

Hi could anyone advise whether my neighbour can erect a home made wind turbine in his garden? He hasn't done it yet, I am just preempting it happening. Today he was trying out an obviously homemade wind turbine. It looks like a large elongated child's windmill. It didn't go around at first so he tri...

Trellis on fence?

If you attach a trellis on a shared fence which is totally on your side but is higher than the fence; does it then become a shared trellis?
Can your neighbour paint it?

Re: Neighbour painting my trellis.

Thanks Hzatph, unfortunately we are forced into 'loggerheads' on a daily basis just to be able to live here with some quality of life. The damage to our property is their response to a reasonable solution we have offered to another dispute they decided to initiate. It seems like they do not like the...

Re: Boundary hedge hacked by neighbours

Sorry DerekAngel but Treeman is right. We are living with neighbours where one has to be on the ball with every aspect of legal and civil law. If it is their hedge on their side then they can do what ever they like with it. What seems neighbourly or unreasonable to good honest people; does not cut u...

Neighbour painting my trellis.

Hi to all. Our lovely neighbours are at it again. This morning 'he' was painting my trellis. This trellis is totally on our side and was put up by us when he raised his garden and we lost our privacy. Politely asked him not to paint our trellis and pointed out that it was our property on our side. H...

Re: Neighbours insist we keep our hedge.

Thanks Despair; your thoughts are noted. Unfortunately we cannot get a fence on their side unless we do remove/reduce the hedge. Even if they did not grieve the loss of privacy; they could not bare the loss of our hedge as it is a more natural feature which they like. Also the boundary cuts at an ac...

Re: Neighbours insist we keep our hedge.

Here's a thought. What if we took a chainsaw to the hedge and took it down to around 3 foot? It is around 8 foot at the moment. We then have not removed it. It would pee them off big time that they have no privacy. It wouldn't matter to us as they have already spoilt our pleasure in our garden...

Neighbours insist we keep our hedge.

Hi, this is a long running boundary dispute with neighbours that want their cake and eat it. They want the boundaries back to the deeds. We said okay but now they only want parts of the shared boundaries to the deeds! Part of the shared boundary at the rear is our beech hedge which did have fencing ...

Retaining a raise garden with a wooden fence.

Hi, does anyone know if it is acceptable to raise your garden and use a wooden fence to retain your soil? Our neighbours have done this and we now have the problem of rain water draining onto our garden but also the fence rotting at the bottom. Is there any rules or regulations in relation to this a...

Re: What do you think?

Thanks Andrew54. We know that the deeds are not accurate enough but it seems to be scaring our neighbours enough to not want likewise to the rear. Thats what we want; to get rid of all their fencing. They will probably object and will almost certainly threaten us with injunctions as they have done i...

What do you think?

Hi, now 3 years down the line. They in 2008 decided that we had encroached on their boundary with our new drive. They erected all fencing between our properties. The front; which is now an issue; was erected by them on the original line of old fencing which predated both our titles. It also goes to ...

Re: Small claims court?

Thank you for your replies to my question. The point is that although one may think we have appeared to have stopped their demand to claim back land that has never been in their title; they, on past history; will at some point take matters into their own hands whilst we are away. When a fence is in ...
