My advice is you don't have to do anything now, it's all on your neighbor to do whatever he deems necessary to fix whatever problem he imagined is going on.

Or tell them that you're cool with the extra use but a future owner of your property might not be, so it's in everyone's interests to get the legal status sorted out now. A bit of cash from them to you in exchange for amending the wording on the right of way? Them covering your very reasonable legal...

They said they have checked their maps and can’t work out if the tree is their responsibility as the boundaries arent ‘clear’ even though it is clearly on their land, What is your evidence for this?
