My opinion only - the verges form part of the road and thus the right of way.

But that doesn't make them a toilet for dogs. It's antisocial not to clean up after your dog.

Reaching the resolution that there is no right of way - that can be instructive and illuminating. How did you come to that? Does the neighbor agree? Etc etc.

That's my cue....

What you do is, when you move your fence back, you don't move it back to the proper previous boundary position. Instead, you move it a meter into his garden. Same as he did to you.

The tar clearly delineates the right of way. I'd be reluctant to allow it to appear identical as your driveway, in case if confusion in years to come as properties are bought and sold and new owners more in. Is that bit useful to help cars turn around on the right of way without backing into private...
