It seems to me your logic is flawed Morgan.

If X puts a fence on Y's land, according to you Y does not own the fence.
But if Y sells the land to Z, then ownership of the fence passed to Z.

How can Y sell a fence he doesn't own? That's illogical.

this is a correct summary of the situation because the law has it that anything attached to the land is considered part of the land - so, unless the neighbour suddenly changes tack and provides clear evidence to substantiate their claim, this fence is attached to the OP’s land. comments suggesting ...

I feel your pain, but there is case law on this. But don't ask me to cite it.... Leafs aren't an actionable nuisance.

No. And don't even think about doing so as a goodwill gesture or the next time the wind blows hard enough to drop more leaves they'll be back at you seeking more "damages".

Agreed. Keep the farmer on-side. When the dust settles on this one way or the other he'll still be a neighbour, and you can neither buy good neighbours nor give away for free bad ones.

.The evidence points to the boundary being in the wrong position. The farmer refuses to sell the piece of ground affected and I know he will not foot the bill to move the fence back.
Seems farmer isn't interested in selling.

What kind of fence is it? You may be able to resite it yourself at minimal cost apart from sweat equity. Or, you could fence or mark the proper boundary yourself and abandon the old fence to the farmer. It's on his land so it'll be his issue to deal with. Best to get agreement on precisely where the...
