Hi celestina, If we can make up our own stories supported by manipulated photos to win legal cases then the skys the limit surely? but they didn't win did they... I wouldn't get too hung up on the distinction between civil/criminal action. The thing with harassment is you want to prevent it and the way to do that is via an injunction. By this I mean your focus should be on stopping the harassment rather than punishing someone. The main remedy is some sort of...

Thanks so much Aborlad, yes, a big paper trail (of alledged harassment too). We will only have 6 months from the last incident... doesn't give us much time to bring a criminal action re: harassment this is why I have asked for your opinions.

Form N1 can be used. I recently used this form to commence proceedings involving interference with a right of way. This claim sought an injunction, declaratory relief and damages. Old aerial photo's might show it? Also, as Pilman suggests, the planning application/consent will give you a date, we are using our planning consent to date some photo's. If needed, we will also approach building regs.

Also, as the cottage is old, can we not assume cars have used this access for over 40 years without challenge? Therefore, an easement is a 'given''? Even so, surely it would be prescriptive? Perhaps a specialist land solicitor might help?
