Re: Replacement sewer treatment plant

Hi,

I'm guessing that this is NOT a case where a drain crossing a property boundary becomes a public drain?

Re: Right of Way advice

Hi Collaborate, Surely the visitors need some sort of authority to claim an easement to visit allotment, or the houses built on the allotments ??? They would have no rights to use the easement as a short cut to somewhere on the other side of the allotments. I'd suggest that a quick settlement, and p...

Re: FTB - property with interesting Boundary and RoW issues

Hi, How about you approach the three neighbours, who may not know that they have an easement, offer them cash to give up their rights. Only they can know what it is worth to them ... and only you can know what it is worth to you (subject to your negotiations with your vendor) But it's all three, or ...

Re: FTB - property with interesting Boundary and RoW issues

Hi, Does estoppel trump an easement? If the garage vhas been in it's present location for a number of years, and is obvious to everybody with an interest, and nobody objected while it was being built, nor since it was built, has it gained an easement over the previous easement? Should ... and how .....

Re: Right of Way advice

Hi DFB The servient owner (your friend) is not required to maintain this Easement/ROW. The dominant owner is not entitled to inprove the Easement/ROW. The present easement/ROW is for the benefit of the occupiers of the old allotments, and I would assume that the same easement/ROW would apply to futu...

Re: Building very close to boundary

It's a bit complicated for my tiny mind. Hi NFH, Ditto ... and thankyou for saying it before I did. :-) So ... the neighbour could be responsible for paying THREE surveyors ... YES? Perhaps it would cost the developer less if he offered to impove his neighbours house FOC provided there was no fuss....

Re: Max. shed height?

Does this mean the part of the shed that is over 2.5m high mustn't be within the 2m, or does it mean that no part of the shed can be within 2m of the boundary? Hi John P, My understanding is that if a shed is more than 2.5m high, at any point, then no part of the shed may be less than 2m from the b...

Re: Neighbour appropriated some of my garden

Hi, There is something in my memory banks about claiming tenanted property. The logic being that the property owner cannot be expected to know everything about what is happening to property that he is not occupying. I cannot remember if it refers to claiming a RoW/Easement, or Adverse Possession, or...

Re: Building very close to boundary

and their solicitor has told me I have to pay half. Hi, If you have to pay half, who is the surveyor working for? Would two surveyors arrive at exactly the same answer? Presumably, the Neighbour would like to build closer to Tinmans house than the existing boundary ... IE: Less than two metres from...

Re: Adopted sewers

Hi Uriah, I believe there have been house extensions built over drains serving whole terraces of houses, with inspection chambers within the extensions. I think the inspection chambers need to have double lids. ??? Ah ... Yer'tiz! https://forums.moneysavingexpert.com/showthread.php?t=5294030 John W

Re: Neighbour appropriated some of my garden

However the conversation goes, have someone on standby who is able to remove the fence from your land and stacked on the neighbours land. Hi, My understanding is that if something is attached to my land ... it becomes my property. No doubt there is a Latin phrase to cover that? If that is correct, ...

Hi Eliza, Fingers crossed for you. I'm guessing that you could avoid any accusation of misrepresentaion, should you ever decide to sell, by leaving the new fence in place, and erecting another on the line where the fence you saw before buying, was,and then splitting the strip from the rest of your p...

A glass half full guy would think that this was a great opportunity to benefit from someone else's error. A glass half empty guy would be worrying about losing their land. Hi Pillman, I don't go with either of the above statemts. Whether the glass is half full or half empty is irrelevent ... ... at...

Re: When is a Communal Garden not communal anymore?

Hi Ramos, What were the terms of the leases when the gardens were all owned by the LA. Were the tenents responsible for maintaining the garden (singular), or were they only responsible for their own identifiable patch. What does your Land Registry entry say about what you own, and what rights do you...

Re: Alleviation of flooding from Road Drains and Sewer.

Hi, If this is a man-made watercourse, then surely those responsible for diverting water into it are responsible for for bhow it affects other properties? <<< There is no quick fix to this sometimes, provided the sewers are clear, and capable of running at 100% capacity, such a volume of rain in a s...
