Prescriptive right of way questions

I was recently successful in getting a prescriptive right of way noted as a benefit on my register of title. The land over which the way runs is owned by the parish council who did object to it but LR granted it anyway. I now hope to get planning permission to build a retirement property on our land...

Re: Access to my property

Hello Peter

Make sure you are covered by the right sort of legal insurance in case any problems/disputes arise.

Hope things work out for you.

Re: Grass verges

Hi Eliza, We also have a condition in our deeds relating to the right of way we have over our neighbours land; "....SUBJECT to the payment of a fair proportion of the expense of maintaining and keeping the road over and across the brown land in repair.... Three years after buying his house and after...

Re: is tenancy agreement correct

Hi Arsie, Yes, I think you're right, we're best to limit our loss and accept the situation we're in. We're very new and inexperienced at this renting game as you can probably guess. Apparently, if the deposit is not being protected by being held in an authorised account as required by the government...

Re: is tenancy agreement correct

Thanks both of you for replying. We will go to see a solicitor as I think we will have problems with this tenant and need to be sure of where we stand. The law seems to be so heavily in favour of tenants especially when they have children, which our tenant has. I can understand this to a point but i...

is tenancy agreement correct

We have a 6 month shorthold tenancy agreement between us (landlords) and a trust. We have served tenant with notice to quit under section 21. We have been told that according to the 1988 Housing Act this kind of agreement must be between a landlord and a private individual, so can't be set up with a...

Re: Right of way access blocked.

I am wondering what has happened to the gate they have removed. You say it is yours. Therefore you should get it back, reinstate it in place of the fence and continue using it as before. Give them their fence back. If they haven't given you your gate back I would think this is theft and threaten to ...

Re: Drive maintenance

We have a ROW over our neighbour's yard to the rear of our property. We also have another entrance. As in your case, we are required to contribute a fair contribution to the repair and maintenance of the roadway (surface) of the ROW. Our neighbour threatened us with closure of our ROW if we didn't p...

Re: Prescriptive rights?

Do you think that the landmark ruling in the Bakewell Management Ltd v Brandwood (2004) UKHL might apply in this case. We used this ruling in 2006, to obtain a prescriptive row to drive over common land owned by parish council in order to access our property. We didn't have to pay compensation. We d...

Re: does electric gate equal locked gate on ROW

We drive up through both gates to reach our land at the top. If you can visualise, its a private drive over which we have ROW. Drive goes straight up the middle between our two houses, NFH's on left, ours on right and NFH turns left into his courtyard which is open onto ROW and we drive straight on ...

Re: does electric gate equal locked gate on ROW

thanks for all your suggestions. Certainly food for thought. The fact that we breathe at all annoys him because he can't get his own way despite trying every trick in the book. We drive thru his yard daily and will continue to do so even though he has threatened to put speed bumps up near 2nd gate (...

Re: does electric gate equal locked gate on ROW

I can't stress enough how crafty & cunning our NFH is. He twists everything. Even if he was away he monitors drive constantly. One day I was walking down drive when someone I knew was passing on the village green. She waved, I waved back. I got back into house & NFH rang and said "you've just waved ...

Re: does electric gate equal locked gate on ROW

Aborlad, no we don't have NFU membership as our house had ceased being a working farm when we bought it. Span, this is the 1st time I have ever posted anything ever on any topic. Despair, I have just typed out wording on our deeds and somehow managed to lose it! Will attempt it again later. You have...
