Re: Top of neighbour's tree blown into our garden

Thank you for your advice. The tree did not actually cause any damage as it landed in the middle of our front garden on grass. My husband looked out and saw what he originally thought to be a branch in our garden. It was much too heavy for him to lift so he had to break it up to throw back over the ...

Re: Top of neighbour's tree blown into our garden

Thank you both for advice. I have been reading through the case you referenced jdfi and learnt an enormous amount about trees. We used to have a silver birch in our back garden, which started to lift the pathway so we had it chopped. The one next door is a much prettier bark than ours was. Since the...

Re: Top of neighbour's tree blown into our garden

Hi Despair
Thank you for the advice. The email I sent did say that he would be responsible for any further damage. Is this enough to cover us?

Top of neighbour's tree blown into our garden

I would be grateful for any advice on a strange problem we have. Our neighbours (who have caused several problems/difficulties in the past) have a very tall silver birch tree, which they planted approx 10 years ago, very close to our fence and very close to their own Listed property. This tree has g...

Re: oversailing boundary

How long has your friend owned his property? Was he able to access the land at the rear at any time without using the neighbour's drive, has he extended his property which prevents access to the rear ground? Might the neighbour be prepared to sell a narrow strip of land to your friend?

Hi
I am sure others on here will advise you on the legal position. I wonder if citizens advice may be any help also. Your neighbour seems to be an extremely awkward individual.

Re: 28 days to remove fence - breach of covenant

Hi ilovemyneighbour It sounds as though your neighbour is a big bully. Pandering to bullies normally makes them worse so imo you should not take the fence down at the present. Such action would more than likely be followed by other demands from him. As Mr Sheen has stated if the worse happened and t...

Re: threat to block my Right of Way

Hi Eliza I appreciate that you do not drive. Every driver is responsible for their own vehicle. Anyone reversing into a main road is at fault should an accident occur. Nothing you may say would be taken into account. If the driver is not able to cope with the situation they should not be driving. An...

Re: homeowner liability?

Hi Just tell them that you have taken advice and then explain the position to them. Say with it with a smile and friendly tone. If they then choose to be difficult not much you can do about it. The worst thing is to appear a doormat. How can it be in any way your fault if the bin driver drives over ...

Re: homeowner liability?

Hi Commonsense would say it is not your fault, nor the fault of the gardener. If the Bin lorry went over your neighbours garden then surely the Bin lorry driver is at fault. Has this been reported to the Council? There will be somewhere on the Council web site to report this and I suggest you inform...

Re: Screening for privacy

Hi We have bamboo used for privacy. Bamboo spreads a lot. It is best to research the spread before buying, which we did. We have it planted in a very very large black plastic pot which is on concrete and raised up off the concrete on a slab. This means we can easily see that the roots are not spread...

Re: Prescriptive rights of way and alternative access routes

Hi I am not good at imagining scenarios at the best of times and now is not the best as I am getting over flu. However I wonder if the following would help you? Presumably you do not wish to access your neighbour's garage. Therefore would it be possible for you to put some heavy pots along the route...
