Have you tried approaching the council to see if they will adopt the highway? I would have thought that if a new development has gone up comprising of multiple dwellings, then the access road to it should have been adopted as a matter of course. We have considered this, but the road is old and twis...

I'm new to this site as well, but take a look at the definition of 'fee simple' on wikipedia, you may already of done this, but it may help in answering your query about the wording before the 'big guns' post some useful replies!
