Re: Neighbour dismantling my fence

Hi NikkiP,

unfortunately, the writing on those images is blurred and unreadable.

contrary to what “cleo5” states, it does not follow that the fence is yours just because you paid for its installation.

could we have clearer, readable images?

kind regards, Mac

Re: Neighbour dismantling my fence

Hi NikkiP,

thanks for the photos, but unfortunately none of that shows that the fence was erected on the land being sold to you.

you mentioned it being referenced in the deeds?

Re: Neighbour dismantling my fence

Hi NikkiP, it would appear the neighbour is of the mistaken opinion that folk can do what they like with garden fences - he certainly isn’t the first and he won’t be the last. this doesn’t make him a bad egg, just as ignorant of the law as many others. however, that may not be the case. The fencing ...

Re: Neighbour dismantling my fence

Hi NikkiP,

My fencing goes along the right side of our bit and along the bottom

did you erect the fencing? if not, what evidence are you relying on to substantiate your claim that it is your fence?

Re: right of way

Hi The surface is gravel for about 2 meters, just where tyres grip the ground. The center is grass. The following 4 meters is all grass and is on an incline, so vehicles do churn it up. I would like to make it all gravel. two gravel trods with a grass between. Do I need to inform the owners of my i...

Hi
Can anyone tell me if the responsibility to maintain a vehicular right of way includes the surface being fit for purpose. Who is responsible, the grantor or grantee or both?
Thank you
the answer is almost always “nobody”

Re: Do i have a right to use this rear passage?

So modern day historians and Wikipedia have sub divided what the actual occupiers referred to a 'back to back' into 'true back to back' and the very posh ' through terraces'. Looks like the OPs is a 'through terrace' classification ....pass through the passageways terrace.??!!! So more suggestion t...

Hi Hps322, IdefixUK wrote: One thing that I think you need to establish is the history of the land upon which the two terraces were built. Re: Title Plan or Original Deed Plan

Hi Mari70,

I am not sure I follow what you mean - I could transfer part of my property without making any reference to its size or the size of the portion being transferred.

From what I have researched

can you share your sources?

It would be really useful to see either a diagram or some picture of this passage way if you can. (or both would be best)
That was the forum will be able to help you further.
Perhaps even the map of your land in the deeds?

Re: Title Plan or Original Deed Plan

Hi Mari70, as both neighbour and my titles match to the back of the outbuildings line, this 50m2 of land is his legally it would seem so, yes. So I guess my initial question is... ...should (I) concede and let him have it and erect a new fence? you ought to accept that you don’t own the land and the...

Re: Do i have a right to use this rear passage?

Hi Hps322, 1. Do i have a right to use the passageway? don’t know - probably not would be my guess from the limited info 2. Irrespective of whether i do or do not have a right to use the passageway, does my neighbour have any legal right to stop me or any of the other neighbours using it? depends, i...

I cannot share the layout. All I can say is the land is to the west and I now own it. I just want to get him off legally.

Hello.

I have just bought some land next to me, however a neighbour has fenced it off and using it. The land was unregistered until I found the owner and bought it. The neighbour fenced it in 2 years ago.

My question is, how do I remove the neighbour?
can we see the layout please?
