Re: Fence with T on our side extends past our boundary. Is it our responsibility to replace the entire thing?

Hi there, I've attached an image for ease of understanding my query. The red line is the boundary of our property, which we moved into last year. The property to our left (plot number 50) is our immediate neighbour. Plot number 31 is the property that both our property and our neighbour's property ...

Re: Dogs Loose on my Right of Way

I get the clear impression that there is a defined route for the ROW that passes along the rear of OP's garden. OP refers to it as "our ROW", which is incorrect as OP does not have a ROW over their own land. They have land burdened by the ROW. The obvious solution is to acknowledge that o...

Re: Right of Access

A proper letter before action will include all their evidence, including statutory declarations from those who can evidence 20 years use as of right. At that stage you can rebut . That's good to know thank you. Sounds like they've got a bit of work to do in the first instance then. We've not receiv...

Re: Right of Access

If or when they make their case you can examine the merit of it then. They have made their claim, as per my original and other posts, including their solicitors email to us as also posted. They claim they have a prescriptive right gained by more than 20 years use as of right. The purpose of coming ...

Re: Dogs Loose on my Right of Way

The OP - Jayden's - OP said, " I have a right of way at the rear of my back garden (we are the subservient owners) which allows my neighbours to access their garden. Our neighbours walk down our right of way with their dogs (three of them) and are not on a leash (if on a leash, then no problem...

Re: Entitled neighbour

Well done in telling Neighb C to stick to their guns, and to not accept anything other than what you are all entitled to. Also, well done to Neighb C for seemingly having Legal Protection on their house insurance ('ahem' to you for not :-) ) What to do? Let NC sort this via their LegProt. Meanwhile...

Re: Advise needed

Our home was built in the 1960s, all with individual driveways. The deeds have the letter T on the left of our property, facing into our neighbours house, but the left wall between us has the hooks of our original gatepost drilled in it ( the whole street has the same, was done by the original buil...

Re: Boundary / Fence being claimed by neighbour

Yes - it is odd. I'll have a read through that - but my hunch is that no survey will show up - as it surely cant take 4.5 months! I did briefly see a surveyor turn up - at the beginning - but he didn't do any measuring or surveying that I saw and was gone pretty quickly - although I noticed on thei...

Paddock
fixed it for you (4 years have passed since the outbuilding went up so now immune to enforcement action)

FilthWizzard wrote: Wed May 15, 2024 4:20 pmWouldn't that make it a shared fence if it is sitting on both OP's land and the neighbour's land? Watch out with such arguments, or OP may not even have the right to replace the wall/fence combo at all without the co-owner's permission.

Re: fence put up 1" from my garage

…someone has… ….put a fence up… ….about 1" from the side of my garage… …are they allowed to do this? yes, someone is allowed to erect a fence are you allowed to use someone else’s land to access the side of your garage without their permission or an easement? that’s the question you first need...

Re: Private RoW not matching on land registries, and use of vehicles

Thanks for your inputs. I think some of the info is getting lost along the way... Here's the summary so far: We accept the way can be used for vehicles for haymaking or anything else in line with the agricultural nature of that field, as it has been since the way was granted. Our concern now is dev...

Re: Dogs Loose on my Right of Way

Asking the police to intervene is straightforward and reasonable. A better way forward than setting traps. The OP understandably doesn't wish to go to the expense to fence off part of their garden and thereby lose it. A polite letter asking the neighbours to keep their dogs from your garden ...

Re: Private RoW not matching on land registries, and use of vehicles

Sorry another quick question. The Right of Way is just that - to pass back and forth. There's no way they could lay additional services underneath the way, is there? i.e. mains water. (Really any development won't be possible without that) Thankyou to everybody - it's a great help. not without e.g....

hi Sarah7789,

apologies if you’ve already covered this, but did the hedge run down the side of their extension? or was it two separate stretches of hedge either side of the extension?

kind regards, Mac
