Re: Party Wall or not Party Wall, that is the question , lol

It seems to confirm that , at the time the deed was made , the marked fences fell wholly within your boundary, but beware in case your neighbours plots say the same. If there was a wall marking a boundary then if it was a retaining wall it was deemed to be a party wall. If there was a wall marking ...

Re: maintenance of the drive we have ROW over

Thank you all so much for your helpful replies. The grassy areas are to the side of the drive over which we have right of way. So, it’s a shame but your responses indicate we can’t do anything about the weeds and old car parked there. Some years ago, we paid for lot of work to be done which they ha...

Re: maintenance of the drive we have ROW over

Our neighbours own the driveway over which we have right of way to access our house. Since they moved in they have not done any maintenance. The drive has many potholes and the grassy areas are now covered in tall weeds. Some months ago they also parked an old car just off the drive. It all looks a...

Re: threat to block my Right of Way

It is confirmed by HMLR that the thickness of a line on a 1:1250 tilte plan is 30cm and on a 1:2500 plan 60cm. OP's reference to 18" is in the middle of these two parameters and therefore the observation is perfectly valid. https://customerhelp.landregistry.gov.uk/forums/register-and-title-pla...

Re: Some questions regarding neighbour's right to actions that affect our wall

hi SnoopyDoo, Do you think it is correct that this would be criminal damage and, if so, what action should we take if his builder starts to take an angle grinder to the wall without our permission? a bit of reading from a quick “google” will tell you that criminal damage must involve damage to prop...

Re: Some questions regarding neighbour's right to actions that affect our wall

hi SnoopyDoo, The Land Registry documentation states that we are responsible for maintaining walls or fences within the boundaries of our land (as marked with a T on the plan), so my understanding is that the walls belong to us and are not shared in any way with our neighbours. what do you mean by “...

Re: Insufficient gravel boards causing neighbours soil to drift

Thanks, tbh I doubt the posts were sunk deep enough (unless the slots go to the very bottom). Fencer would have to remove all concrete from the base to try to slot in gravel boards. He was proposing digging and putting boards with concrete behind them to hold them in place on the neighbours side. H...

Re: Fence Post Support

I have a wood panel fences with wood post sunk into concrete. It has been like this since we moved in 3 years ago. The fence is ours as confirmed by our neighbour/legal documents. I know the fence was installed prior to our ownership and when installed, one of the wood posts was supported by a low ...

Re: Clay soil tree flooding

Hi all, I’m new here and need some more opinions and advice about flooding laws. I have confirmation our gardens are clay soil. Well most of mine is free draining normal soil. Neighbours garden slopes and highest point is 4-5 feet which gradually goes down to about 1 feet higher than mine. All gard...
