Re: Can you build an additional property on your land with only a right of way.

Thank you Mr Sheen, very interesting, and appreciated. Macadam...I only wondered if someone could enlighten me as to whether appealing at 'the eleventh hour' was common practice and in any way a ploy, and if so what advantage there could be. Whatever my opinion of my neighbour is, has no relevance,...

Re: Can you build an additional property on your land with only a right of way.

Thanks....Not sure if there was a conscious reason or advantage in leaving the appeal until the last few days, of the 6 month window, to do so. Don't really know what you mean by 'sniping/implications'. why did you feel it necessary to go further than informing us they’d lodged an appeal? the “elev...

Re: Can you build an additional property on your land with only a right of way.

Hi guys, cheers for replying. I believe the applicant had 6 months to appeal, and he did so one week prior to this deadline. All it says on the planning application is "...APPEAL LODGED BUT NOT YET DETERMINED". As it stands we are unable to provide input, maybe be this will change when th...

hi ZoeC, the title of your thread doesn’t seem to tally with what you’ve described in your first post. without further details it’s not easy to help. would you please share an image of the layout and photo of the bin store - upload these to a 3rd party image sharing site (e.g. www.imgbb.com ) and t...

Re: Can you build an additional property on your land with only a right of way.

Thanks for your reply. In my case, I believe that his ultimate plan is to not just build the one house, but anything up to four. His planning application was initially refused for a number of reasons and I thought it was dead in the water, but he has lodged an appeal, on the eleventh hour , which i...

Re: Neighbour attaching Privacy slats on our side of HIS fence

Thank you wtc! And yes, you impression is correct. The trespass aspect of waking up to find their guy walking around our garden without permission after having let himself in by lifting up a fence panel at the other end of the fence in our back garden WAS unpleasant, sure, but from what I have read...

Re: Boundary Wall Extends Into Council Area

You cannot be responsible for something you don't own. If you have to replace your wall then do so. The county council will be responsible for the wall that stands wholly on the public highway. except a wall cannot stand on a public highway, can it? What makes you say that? Is that something create...

It's the roots that matter, not the stems. If the roots are attached to your land - it' your hedge.
must mean I part own my neighbour’s apple trees as some roots have grown into my land - nice to know, thanks

Re: Hedge issues

I have lived in my house for over 20 years when it was new . I have a terraced house next to me and a hedge between us . The hedge has died and I want to replace it as the roots are over my side of the boundary line . I mentioned to my neighbour that I was thinking of having this done and of course...

Re: Fence alongside an easement to separate 1 garden into 2

Update So I have spoken to my neighbour..finally. He has agreed to allow me to put in 2 garden gates, one at either end of the path. One will block the view of the balcony and the other, in part, the schoolhouse. He did not like my idea of the fence as he believes the easement (as per the comments ...

Re: Am I allowed to use the alleyway that goes around my neighbour's house to the back of mine?

Hi Mac, thanks for the advice. I've done a sketch, hope this link works? https://imgur.com/a/Hckysf2 which is the semi-detached house with the path? The neighbour's house is the semi detached one, the path is the shaded bit that goes around and to the back. but on your sketch the only house labelle...

Re: Neighbour attaching Privacy slats on our side of HIS fence

Hello all, I wonder if anyone could be so kind as to help. Our Neighbour owns the 7 ft fence that runs across his back garden (this height includes both the panels and the Gravel boards) and on our side, goes down the length of a side alley which runs along side our home. Last month he started flic...

Re: Am I allowed to use the alleyway that goes around my neighbour's house to the back of mine?

hi Cupofteaaa! it would be helpful to see a plan/sketch of the layout. doing this the “traditional” way - uploading an image direct on here - isn’t really viable as 1. new users need to make multiple posts before this function is enabled and 2. the forum’s servwr is near capacity as far as image st...
