You have a legal right to remove, but no obligation to return. As soon as she attached it to your fence it became your
property. Remove it and store safely incase she asks for it back or sends the police round to collect it.

The land owner is the servient tenement and can have as many dominant tenements as he wishes. As he also owns the lane he
can sell Rights to whomsoever he wishes. Without consulting other dominant tenements.

As this area of garden has been 'walled in' for the last 30 years I would be tempted to keep quiet about it and just buy an
indemnity policy against any future ownership problems should you want to sell.

Contact the highways dept. of your local council and explain about the large vehicles getting stuck down the lane and ask if they will install two signs at the entrance to the lane that state "road narrows ahead unsuitable for hgv's". If installed it may deter most large vehicles from using the lane...

When you do build your house could you not install your drive alongside and at the same level as, and cambered towards your neighbours, with a drainage channel between to take the rainwater out to the surface water drain in the roadway?
