Re: Right of way over a commercial car park

The lease gives them no right to park in the car park. but if folk visiting/using the green have been parking in the car park over the last 20+ years as of right (without secrecy, without force, without permission) the right may have been acquired (for the remainder of the lease). Kind regards, Mac...

Re: neighbour threaten me to clear alleyway for his access

don't lose your temper with him ... he might just have a poor way with words.

just ask him if he can help clear it. and if he turns into an arsehole about it...... then write him letters so everything is documented that you havent made any attempt to block his access.

Re: neighbour threaten me to clear alleyway for his access

I'd ask him to prove send you a copy of hi...

petal

having read your other thread. and having made a point about the difficulty in identifying who would be negligent.
there may be more than one "occupier" who is negligent and there may be other third parties who are negligent too.

Re: Repair of right of way to a safe standard

If this is the only access to your property then the post people etc etc have to use it, these people have a right to expect safe passage to your property and if you do not maintain the passage to your property they have the right to sue for any injury they sustain. As it appears that this drive se...

Re: Do my rights allow a tradesman to park in a private road

I think you have to put aside money to defend it

then politely ignore the twit until you get a summons. If youve already got right to park , its like someone suddenly turning a right of way into a Toll Road

personally id get a load of cars and dump them all over the road when the owners out.....

It seems if you are taking your own waste to the tip you need a licence
you dont need a licence to take your domestic waste to the dump... but you would if you took your aged next door neighbours bag too

Re: Do my rights allow a tradesman to park in a private road

a right to park can exist as an easement .... how long have you all been parking there? Also the can of worms I earlier suggested is the rigmarole linked to the ability to issue and enforce PCNs for parking on private land. He cant find out who the vehicle belongs to unless he joins the right associ...

I live in a private road too but we each own the bit in front of each house.

he cant fine you for parking ...... and I think he has a can of worms for enforcing it

Re: Do my rights allow a tradesman to park in a private road

Its irrelevant apart from building a profile of the neighbour. To see if its a similar experience to my own. The neighbour bought the road for a reason. I was wondering if they wanted everyone elses vehicle moved so they gained sole parking rights my neighbour has issues with tradesmen parking at ne...
