Re: right of way on title register not accepted and blocked

Hi all, our solicitor got back to me on Friday suggesting we may be getting our right of way back but gateway want assurrance that we will not use it exccesively and to "advise nfh in advance". So much for the strongly worded letter (there hasn't been one). People walking past our house have made co...

Re: right of way on title register not accepted and blocked

Yes duvet the pipes do run under row.. We have had an in depth meeting with our solicitor and we agreed to writing a strongly worded letter and advising possible court action against them should do the trick, if no action is taken by gateway to remove all obstruction then we shall be applying for a ...

Re: right of way on title register not accepted and blocked

Pilman you have understood my situation to a T and i agree your knowlege and wording is so perfect you are an asset to this site. I have taken your advise and the advise of others on board, I will keep you all posted as things progress. My mind boggles as to why gateway would put themselves in this ...

Re: right of way on title register not accepted and blocked

In case you are not familiar with certain legal terms, once you had purchased the property from the council you owned the "Legal Estate" in the physical property and you owned a "Legal Interest" over the retained land of the council in respect of all easements that existed when the council owned bo...

Re: right of way on title register not accepted and blocked

Re: right of way on title register not accepted and blocked

I have made an appointment on monday with our (lame) solicitor to discuss mediation and other possible options which are available to us. What I don't understand is why our solicitor has not yet mentioned injunction or court action against gateway, maybe Monday. I'm certain now I will be asking soli...

Re: right of way on title register not accepted and blocked

it would be far better if you commenced proceedings against Gateway who are the landlords. So her family are on the board - you can find their names very easily. And don't get into pointless arguments with the tenants who will then call the police. you want them to be the antisocial ones not you. d...

Re: right of way on title register not accepted and blocked

The arguement here is with Gateway. If the RoW is on both deeds then there is little investigation to take place simply write to them via your solicitor requiring that they keep the RoW unobstructed for your use as set out in your deeds. You should then formalise a complaint concerning their tenant...

Re: right of way on title register not accepted and blocked

Even though we have title deeds stating our right of way and on their deeds too? What's the point of having title plans if its not a statement of truth or fact, it clearly states that easement and row are transfered with the property, could they then also dispute who the title plans belong to? I tho...

Re: right of way on title register not accepted and blocked

Thanks for your replies, we have been visited by the police on a number of occassion, the last time was when her 15 yr old son was shouting over calling me a mong and insulting us telling us to leave his mum alone, I told him in not so many words to grow a pair and have some manners and respect, whe...

Hello everyone I'm hoping someone can help me, ive been browsing this site reading forums again and again but can't seem to understand why this is happening to us. We purchased our house from the local council in 2005 after living here since 1996. Later on in 2005 the council transfered all their re...
