Re: Enforcemnt or retropective planning

Hi Aborlad

No, that thread is all water under the bridge.....

This topic refers to a holiday let/house we own and to which we were planning on retiring but the fence and sheds (he's put what looks like bright green astroturf on the roofs) have severely upset our plans....

Enforcemnt or retropective planning

My neighbour has not only put up a new fence but has moved it right to the edge of his boundary where defined by the public footpath and it is now about 1mm (yes 1millimetre) from the footpath. In fact at one end the feather boarding slightly overlaps the footpath. Immediately behind the fence, with...

Re: who pays for reapirs to my driveway?

To Devonjem, many thanks for your cogent reply, much appreciated. To Mac, sorry to confuse. For my neighbour to reach his front door he has to walk about 18 feet down the driveway from the roadside where he parks. I suppose that's a bit more than a 'few' feet, but it's no great distance and as I say...

Re: who pays for reapirs to my driveway?

Hi Mac, thanks for taking the trouble to reply; I did cut out what I assumed were merely the list of who (servants etc) can pass and repass along the driveway. The key parts, to my mind were the bits about 'purchaser and successors', and that they should pay half the cost of repairs and maintenance....

who pays for reapirs to my driveway?

Whilst I've found some posts relating to this question I can't find anything specific enough. Our Property Register has a charge relating to our driveway whereby, "Together with the right for the Purchaser and his successors in title owner or occupier for the time being of the property... etc their ...

Re: Hedge and property easement

The hedge and environs were surveyed and the result was much as expected. The surveyor also stated that the right to light issue was not actionable and that a prescriptive right to cut someone else's hedge seemed very unlikely. Question is where do I go from here? My annoying neighbour has stated in...

Re: Hedge and property easement

Oh yes, forgot to say that I did reply to solicitor's letter but would have done so differently knowing what I now know. My reply was effectively ignored and I suppose I was forced to back down. Not this time should the same happen. I note that according to Article 1 of the First Protocol of theEuro...

Re: Hedge and property easement

Thank you again to the replies. To Arsie: what you say makes a good deal of sense and I have good reason to believe that having looked into this further you are correct . My understanding is that unless the loss of light is very obvious (e.g. new 10 ft wall right in front of kitchen window) then my ...

Re: Hedge and property easement

With respect to 'Despair' the neighbour in question is definitely not a gem in my experience- I only explained one small part of the whole story so as not to go on too much and add irrelevant information to my question of whether he can obtain rights over the hedge by tending it for 20+ years. You r...

Re: Hedge and property easement

Thanks for that. What you say makes good sense- keep our 'powder dry' on the legal threat option. After a previous run in when I told him that he must ask my permission to cut the hedge he had his solicitor write me that ' he has every right to tend the hedge having done so for 25 years' and also th...

Re: Hedge and property easement

Thanks for the answers. I do think that my neighbour would find it difficult to claim an easement that gave him unfettered rights to tend, trim etc the hedge No right may be asserted as an easement if it is "too vague and too indefinite" This has been going on for sometime and now my other neighbour...

Hedge and property easement

My neighbour to the North whose property is I understand would be servient to ours has an access easement down our driveway. He has lived there for 31 years and has regularly cut/tended the hedge lining one side of the drive and was almost certainly doing this before we arrived. I am concerned that ...
