Re: Legalising unregistered land

The words used apply to all easements not specifically mentioned in a conveyance but in respect of drainage easements how often are these set out in a conveyance. In all probability the houses that were built as 23, 25 and 27 had the bathroom or outhouse located at the back of the house. The sewer ...

Re: Legalising unregistered land

Only when I thought I wouldn't post for sometime... 1. Access to the rear of 27 has never been via the path beside 29. Tbh I don't know. There may have been access to 27 via 29 because 31 has got a shed at the back of his garden but there IS access for 33 from behind that shed. Same goes f...

Re: Legalising unregistered land

Thanks for all your replies and I am going to park this (for now) A few points seemed to have been missed or ignored in the replies but it maybe that it's not for this forum. But for the benefit of others 1) @pilman mentioned that I constructed the new brick wall causing substantial obstruction but ...

Re: Legalising unregistered land

Hi olisun, Any chance of some snaps of the front of 23-29 and 31-37? Kind regards, Mac I will try and do that tomorrow morning... I would be ultra cautious about going down that route! I have been taking photographs of all the cars parked in our street since the last 2 yrs to support the CPZ and no...

Re: Legalising unregistered land

before finally deciding what action he is to take in resolving the problem now being freely discussed on Garden Law where everyone seems to have different ideas about the best way forward. Not sure if you had a chance to read my previous message To be clear I am not trying to "grab" the unregistere...

Re: Legalising unregistered land

There is no possibility that 29 has a lawful right of way using the unregisterd land behind 23 and 25, but on the balance of probability it seems to be more probable than not that there is a right of way for the benefit of numbers 23, 25 and 27, although that right of way has been substantially obs...

Re: Legalising unregistered land

Hi olisun, Do any of 25, 27, 33 and 35 Stafford Road have a right of way mentioned in their deeds? (over somewhere else rather than the unregistered strip) Kind regards, Mac I have downloaded 23, 25, 27 & 29 and they do not have any ROW mentioned in the deeds. The same was confirmed by the CSR at L...

Re: Legalising unregistered land

Btw I forgot to mention that the "main" door of the house is NOT street facing but it faces towards the non-reg land. One of the previous owners built that enclosure because the water from the roof used to fall on the main door and come into the house. And the roof is plastic because it doesn't requ...

Re: Legalising unregistered land

To be clear I am not trying to "grab" the unregistered land but making sure that the security to my house is not compromised. For the benefit of this thread I will just summarise some points The landlord did come over back in November (I think) requesting access via my front porch to do move materia...

Re: Legalising unregistered land

Hi olisun, I think there was a passageway between 29 and 31 as the distance between these 2 properties is very wide compared to the others. i.e 29's garden is wider than 27's I asked for information about the original terrace 23-27 which was built in or before 1914. Properties 29 & 31 are not relev...

Re: Legalising unregistered land

If Anon is gym man then he is hoping that the op postulates and fannys around long enough to use the land therefore stopping his claim in it's tracks. Tbh I still didn't understand the "use of land". You mean start storing bins etc? and I can only "use" it till the end of the yellow part and not be...
