Re: They need to stop building on flood plains then

[quote="Collaborate"]As many UK citizens live abroad as live here - and the ones here tend to be more economically active than UK emigrants. Re: ROW issue on plot about to be built on.....

I wouldn't rely on being 100% sure let alone 98% where council planning depts are concerned. If you start building and then the council decide not to extinguish the claimed footpath, how much will that cost you? In my opinion (I am a developer / builder), I would not start the build until it was all...

Re: Right of Way - Insurance

Hi nugent, Who says there is a right of way over it, if it is not mentioned in your deeds? Are you obliged to maitain it? Even if there is no official right of way, you may still be held liable in the event of an accident, if it is found that the roadway was in a state of disrepair. Even persons acc...

Re: maintenance work on unadopted private road

I agree, I would not pay a penny until I had seen a receipted invoice for the full amount including a detailed description of works undertaken and any VAT paid or payable. It would be a good idea to employ a surveyor of your own to look over the invoice, works and tenders for the works. If a buildin...

Re: Neighbour's dog fouls my lawn

Speak to the RSPCA, they may be able to loan you a dog trap.

Trap the dog, call RSPCA, they will take it away, the owner will have to pay to have dog returned.

Re: Want to move outwards our side fence panels and gates

I would concur with ukmicky here, it best to speak to planning officers, this can be done by making a 'pre planning application' this is usually free, and will result in a meeting with a planning officer, who will give you a clue as to whether or not you will gain approval, and what kind of applicat...

Re: Parking On Right of Way

Adverse possession of a house is not a good thing, itsa criminal act. He also may be doing it up to rent it out to scam the tenants. People entering property not belonging to them and renting it out is becoming a big problem in some cities these days with many people losing their deposits when they...

Re: Parking On Right of Way

I think, if the occupiers have gone to the trouble and expense of erecting a scaffold, removing plaster etc from the walls, presumably replastering, repairing roof, etc, they are not your average squatters. I think they will have great respect for the property. They could be investing more in the p...

They will send you a form and if this property is bona vacantia...

it's looking like they do actually own it otherwise some one would have been by now to interrupt the adverse possession ,with the stink you are kicking up ,and if that's the case ,what have you to lose by taking coggy,s advice,it may help make an unbearable situation a bit more bearable I agree, we...

Re: Parking On Right of Way

I would ask the OP, would you have the same resistance to the occupation, and adverse possession of the property if it were being undertaken by a middle aged well to do family? As we know on this forum, adverse possession is a good thing, as is neighbour cooperation during building works or renovat...
