Re: TP1 AP1

A client of mine (getting divorced) thought he’d save a few £ in Legal fees by doing a transfer of property himself. So far it’s cost him around £20,000 more in legal fees as it’s such a complete mess.

Don’t try and do it yourself. Pay for someone to do it for you.

Re: Development of a studio built in a garden

It is entirely unnecessary to reference where the neighbour comes from.

Also, reference to the neighbour having "African values" is equally inappropriate.

Despite being asked not to comment further... This is a public forum. You seem to have deluded yourself in to thinking you're a moderator. And an abusive one at that. Yes, that's right. It is a public forum where people like myself come with problems for help and advice. Not to be patronised and sp...

Hi Chunga,

I think anyone reading this thread will have understood that the developer is African so please stop referencing this point - is he a tall developer? middle-aged developer? slim developer?

kind regards, Mac
It had made me rather uncomfortable as well.

Re: Vehicular ROW dispute - claim of false deeds!

Hi Bellatrix LeStrange, I found it online on a legal firms site would you post a link please - for the benefit of the forum. kind regards, Mac Hello Mac. Of course. Here you go. I got it slightly wrong, in that it is not on a law firm website, but the author of the article has an LLM. Her step 3 co...

Re: Vehicular ROW dispute - claim of false deeds!

So, let's assume the neighbour's land increases in value by £20k if there is no ROW. This is a figure plucked out of thin air by the way. The plot of land is 100m2. The ROW footprint is 20m2. From what you're saying you'd be asking for £4,000 from your neighbour. Is that what you're saying? That you...

Re: Development of a studio built in a garden

Well Hammersmith & Fulham does not allow double basements. The studio does not have a garden as it has filled the garden space. Its floor is already at the same level as all the basements in the same street, but the African developer has already dug down two metres below the existing floor. I do no...

Re: Vehicular ROW dispute - claim of false deeds!

Here I am again. Not sodding off. It's part 4 of your masterplan that I think needs to go back to the drawing board. You say measure the area of the ROW and multiply it by the difference in values to arrive at the value of the ROW. What does the area of the ROW have to do with it? What unit of measu...

Re: Vehicular ROW dispute - claim of false deeds!

I'm not sure where you got that from but it sounds completely wrong. Give your ROW away if you want to go ahead with that calculation. You seem to say that you will look at the benefit of the increase in value of neighbour's property and work out what area of the land is taken up by the ROW and take...

Re: Survey shows extent of incorrect fence position

No. You don't understand, but perhaps I'm not explaining myself correctly. Whenever property is transferred there is always a transfer deed. These days it is a form from HMLR called a TR1, or a TP1 if a transfer of part. In days gone by it was a document fully typed out and so the form of such trans...

Re: Survey shows extent of incorrect fence position

My property shows a disconnect as per my survey plan. In fact my title plan shows property B with almost all its land intact ! However his property plan shows no disconnect as it’s an incorrectly filed first registration plan and does not seem to have been updated properly. So there is clearly the ...

Re: Survey shows extent of incorrect fence position

You've not dealt with the point 1 in my first post on this thread. You're fixated on the plan but that might be dangerous when you look at the transfer deed. How is the property described?

Re: Survey shows extent of incorrect fence position

My land registery title plan is correct whats not correct is the current hedge position. You can’t claim adverse possession for incorrectly registered land https://www.maitlandchambers.com/information/recent-cases/horace-parshall-v-clara-hackney-2013 The older title will take back the land. Propert...

Re: Survey shows extent of incorrect fence position

this looks like it's going to get very messy given the properties built on the disputed land. Various issues here. 1. What was intended to be transferred as part of property C when it was transferred to you? there was a disconnect between the plan, and what was there physically on the land. You'll h...
