Re: Help needed

You need to post a plan. I can't make out the layout from what you have written.

Also please download copies of the title to each property from HMLR and post what it says about this plot of land.

Re: Dogs Loose on my Right of Way

Some of the more bonkers responses seem to have scared OP away. OP was concerned about dogs on their land. This is land the neighbours have a right to be on. They have a right to take their dogs with them, but no right to allow their dogs to stray beyond the ROW route. Assuming the path of the ROW s...

Re: Right of Access

You’re tying yourself up in knots unnecessarily. It’s for those asserting rights over your land to make their case. It’s not for you to imagine what their case might be. If or when they make their case you can examine the merit of it then. Without having to contemplate esoteric principles of land law.

Re: Dogs Loose on my Right of Way

'The dangerous dogs act describes penalties for dogs which are intimidating. The OP described being intimidated by the presence of the loose dogs. This is a matter in which the police can assist. Fantasy land. Plenty of people don’t like dogs. They don’t get to call the police on them just because ...

Instead I wanted to know how to get this changed “officially” via Land Registry.
This has been answered.

Re: Right of Access

Can you stop referring to company B and company C? It’s the same company whatever they choose to call it.

This is partly where the confusion has come from.

Re: Right of Access

So you have now established that from 2002 to a few months ago both properties were owned by the same limited company. the names are different on the title because that company changed its name at some point. So there is no right of access. Full stop. Do not engage with the solicitor further after y...

Re: Right of Access

So the letter from the solicitor provides more clarity. The claim is that since 1998 no 2 has had access to the rear of their house by crossing the rear of your house. They specifically say “as of right”. Your very first post said that when you bought the house the seller told you the property was b...

Re: Determined boundary

How on earth could anyone tell you that? You haven't given any information about your case.

1. You object: your objections get listened to. If they are valid then the neighbour fails.
2. You don't object: your neighbour gets what they want.

Re: Right of Access

If that is all they've said then they are blustering. They have not set out a coherent argument about how that right arose.

I suggest you fence it off.

Re: Right of Access

Not what I was after. You are concerned that neighbours claim a right of way over your property. The claim appears to be specifically that the rights arose over a certain period in time when the owners of your property (please don't refer to them as property 1 and property 2 - i forget which is whic...

Re: Right of Access

There are too many posts for me to pick out the relevent dates and events. Can you explain when you think these rights were acquired, who owned each property at the time, and what the individual you think acquired the rights for the property did in order to acquire those rights?

They are therefore not the same companies and joint ownership does not apply from that later date.
