Either go down the legal route....lots of hassle and vast expense. Or agree on cost of new fence to the benefit of both parties, and share the agreed cost...The work to be done by a reliable fencer agreed by both of you. Get a fencer in to advise. Or get a few quotes. Chop out anything causing fence problem .Pay for repairs yourself . Job done.

Chop off roots pushing through fence at the moment .Any buyer will be aware of trees when they view so not really a problem yet.
Just get the overhangs trimmed and fence intrusions sorted.
Buyer buys what he sees.

Agreed MW1965, You say trees are within one metre of your fence. What sort of trees are they? You can certainly remove all stuff coming through the fence to your side. I would, were I you, lift a line of patio sllabs and see whether any roots lie shallowly beneath. If so chop them all off and replac...
