Re: Council's derogation from grant? (access to the property

Thank you for clarifying, arborlad :) Well, I think a FOI request may not be such a bad idea... I will wait for the experts to give their opinion on the contents of the deeds first though ;) There is a dropped kerb where the gate is and it extends to where the fence is (land owned by the council). I...

Re: Council's derogation from grant? (access to the property

I was also advised that a previous application submitted in 2004 failed because the council was concerned that if a retailing wall was erected where the slope is, they would have no access to the back of the bungalows. They've got even less access now and not only have they accepted it - they have ...

Re: Council's derogation from grant? (access to the property

If you have a right of way and the gate is blocking your right of way and that gate is on land owned by the council ,the council will be the ones that you will need to take action against. The gate is not on land owned by the council, nevertheless I suspect it is still the council I would be taking...

Re: Council's derogation from grant? (access to the property

It appears to me that the council are more than happy to let somebody else secure their property!! I think you should perhaps consider an injunction on the council to remove obstructions from their land that prevent your rights of vehicular access to your premises. The land in front of your house i...

Re: Council's derogation from grant? (access to the property

The council are aware, their planning department informed me they inspected the property...... .....Plus they use a contractor for their planning stuff,. I'm somewhat confused by these contradictory statements, as far as I'm aware all planning departments for all councils are in-house. If you wishe...

Re: Council's derogation from grant? (access to the property

Pilman is correct its vital to have possesion of ALL of the copies of land registry documents surrounding yours your neighbours and the land in front of both houses From whats been said already plus the photos i honestly do not see how your neighbour has any right to block your access like that nev...

Re: Council's derogation from grant? (access to the property

Rob Lewis gave you the answer to this problem in his earlier post, we see so many cases similer to this, look after yourself like the neighbour is. Well, technically I'd be trespassing on his land and damaging his gate, so not sure I would be acting lawfully? The most obvious option would be to rem...

It's my porch.

I park my car on the main road because I cannot access that plot of land in front of my house because of the locked gate and the fence....

Re: Council's derogation from grant? (access to the property

Hi Are you aware if the neighbour or any of his family work for or are connected to the Council, i.e. a Councillor? That can make a huge difference. Coggy Hi We don't know what affiliations they may have. I found it strange when they started parking away from my window literally 48 hours after I co...

Re: Council's derogation from grant? (access to the property

How high is the fence?...............in that location, it should be no more than a metre. It is over 150cm and the gate is higher than that. I have informed the council about that and their response was that it provides 'security' to the bungalows, so they won't do anything about it. I would really...

Re: Council's derogation from grant? (access to the property

Why it matters is that my neighbour (neighbour A) has erected a massive iron fence that fences off the whole area in front of the houses from the main road. He only owns the plot directly in front of his property but the fence goes all the way down alongside the main road and restricts access to th...

Re: Council's derogation from grant? (access to the property

Thank you for your responses. The only problem is that my access to the land in front of my house is blocked because of the fence and the locked gate, so I have no means of doing what the neighbour did. Apparently the previous owner of my property tried to purchase the land in front of the property ...

Council's derogation from grant? (access to the property)

Hello I am new to this forum. I would like to ask a question about the content of my property deeds and my right to enter the council's land. I have drawn a plan of the area where I live to the best of my abilities... I have attached my drawing which is based on my knowledge of the area, the Land Re...

Re: single occupancy

Hi If you take action for breach of contract, the court will decide. It can be costly and not worth it, especially that if your tenant lives in an annex, her rights are limited (it is not an assured shorthold tenancy, in case the agent made you think so...). Is the presence of the boyfriend disturbi...
