Re: Hawthorn tree straggling boundaries - conservation area

Hi As I am not getting any response re my problem - I guess the neighbour can, provided it does not grow beyond a certain limit as determined by the High Hedges legislation, grow his Leylandii hedge through the branches of the tree whether it is a conservation area or not. How this affects the tree ...

Re: Hawthorn tree straggling boundaries - conservation area

Hi To Thanks for your reply. I guess I did not explain properly - the Hawthorn tree trunk is mostly on our side but some of the roots and certainly branches go on to our neighbours land and airspace. Unfortunately, a Leylandii hedge on our neighbours side, which was well below the lowest branch of t...

Hawthorn tree straggling boundaries - conservation area

There is a Hawthorn tree straggling the boundaries (conservation area) but as we have looked after it for a number of years 28 - it has been regarded as our tree. However, neighbour had a small, in height, 2.54 metres, 45 degree angle Leylandii hedge. It has grown much higher, cannot be sure how hig...

Re: High Hedges Legislation

Thank you To for responding.

It really is complicated To. I have taken some action - see what happens. Judicial Review is quite an expensive option having checked with Solicitors.

Re: High Hedges Legislation

I am reviewing the situation re high hedges and I still am not able to get an answer to hedge height and list loss spreadsheet, amendments - enter height of floor above ground, else enter zero. The property affected is a bungalow - i.e., a ground floor? what does this amendment mean? Other question ...

Re: High Hedges Legislation

Hi APC Thank you for your response - yes, the case was turned down but they came up to have a look at the situation. They did not do a formal report. Strange why they talk about Judicial Review. Reasoning being if it is felt the Act was not applied properly or unfair. Just as a matter of interest wh...

Re: High Hedges Legislation

Hi Despair

Thank you very much for responding to my message. It is very complicated case but when a case is turned down there is the option to go to judicial review and that is the only option given in writing. I just wondered if complaining to the LGO was an option if one should complain.

Re: High Hedges Legislation

My High Hedge Application has been turned down. Apart from Judicial Review can one complain to the LGO? If so is the time scale 28 days?

Re: High Hedges Legislation

Thank you TO.

My interpretation is, judging by the diagrams, no you do not include the garden area where the hedge cannot be seen - in this case the front of the property. Could I be mistaken?

Re: High Hedges Legislation

Hi

Any High Hedge administrator's out there who can answer me the above question? I am trying to assess the situation in going through High Hedges Legislation. As they say - be prepared! It looks as though this is my only option though.

Re: High Hedges Legislation

Hi, Just a small query: When carrying out calculations for the garden area for High Hedges, it is often said the whole garden is taken into account. However, if the hedge cannot be seen by the whole garden, say for example it is at a 45 degree angle at the side of the property and in no way can this...

Re: High Hedges Legislation

Unfortunately that would appear to be where they cannot see our house and they do not want u...

Re: High Hedges Legislation

Hello Collaborate

Thank you for your reply; disappointing though it was. I was thinking maybe going through the law of nuisance? It is not what I want but I am at the end of the line.
