Re: Development of a studio built in a garden

Councillors decisively and unanimously rejected the 16th planning application. A motion to seek legal advice on whether Section 70a of the 1990 Town & Country Planning Act was tied. The developer submitted three applications which both he and the planner conceded were very similar. One was ignored,o...

Re: Development of a studio built in a garden

Thank you. The planners have turned down one of three applications. They apparently believe that just changing the number of windows creates a new application. This is despite the fact that the numbers of windows given is false. If you have spoken to the planners, you will know that they detest this...

Re: Development of a studio built in a garden

The planner claimed that it was not a double basement - but without further explanation. It was clear from the poor diagram that this is exactly what is proposed. The intention of LBH&F following RBK&C is to avoid dungeons underneath existing basements. These are popular in London areas with high la...

Re: Development of a studio built in a garden

The planner threatened with beheading has sponsored another odd application. This is to demolish a garage. The pumps are long gone, but it still has a large apron. The body-shop behind repairs wrecked cars. It has a big shed of about the same height as the studio. It cost the same around £300,000- b...

Re: Burglar tactic?

I can only speak for the Metropolitan Police and for London. I sincerely hope that the comments that I make are not applicable to rural areas in the rest of the country, where the local population differs, in many respects. Nobody would bother to drive a van around seeking to work in back gardens. It...

Re: Development of a studio built in a garden

At the outset, it did look as though the planners were friendly, to the developer. One wanted to pass the fourth or fifth application. The planner responsible for conservation area rules did not even make a comment. Both were roundly condemned at the Appeal Hearing which rejected two very similar ve...

Re: Development of a studio built in a garden

The Metropolitan police response to any request for assistance short of murder is "it is a civil matter." Our local cemetery has become a drug market in broad daylight. It seems that you may need proof of at least two cases of intimidation to the same person, threatening violence, before they will t...

Re: Development of a studio built in a garden

The developer has now got hold of the names, addresses and phone numbers of objectors. He has sent intimidating letters and made intimidating phone calls. He has threatened to sue the planning lawyer for libel. He has threatened to "take the head off" one of the planners. People with small children ...

Re: Development of a studio built in a garden

Notting Hill Housing Trust whose four storey building with a basement (as defined by Hammersmith & Fulham in its 2019 planning document modeled on Kensington & Chelsea) has been undermined by 2m of excavation has been refused access to its party wall surveyor. Can anything be done? Three simultaneou...

Re: Development of a studio built in a garden

No

Hammersmith and Fulham defines this as a basement.

I do not wish to name the Developer because he has already assaulted a planner and a neighbour and threatened to sue the Council. He has had two bankruptcies and two High Court Actions.

Re: Development of a studio built in a garden

Well Hammersmith & Fulham does not allow double basements. The studio does not have a garden as it has filled the garden space. Its floor is already at the same level as all the basements in the same street, but the African developer has already dug down two metres below the existing floor. I do not...

Re: Development of a studio built in a garden

The Cameroon developer has put in three new planning applications. All are substantially identical to ones already rejected, apart from the number of windows.

It seems probable that his company is already bankrupt.

Re: Development of a studio built in a garden

Fortunately planning rules differ even amongst neighbouring London boroughs. Kensington and Chelsea has been plagued by film stars, footballers and foreigners digging huge basements under their gardens and often the pavement. These houses almost all already have conventional basements. So it has ban...

Re: Development of a studio built in a garden

You are absolutely correct. The planning process in this London borough is a farce. Planners and lawyers employed by the Council seem to be unaware of the provisions both of the Town & Country Planning Act 1990 ( which seeks to prevent repeated identical applications) and of the modifications to pla...

Re: Development of a studio built in a garden

We had a visit from one of the planners. He is a south African who has not lived in the UK for long. He did not seem to recognise the Council`s own definition of a basement. The studio is an odd building in that it was built in 1885 with a large north window and skylights as a very small thin-walled...
