An alleged offence under the 1861 Act is a matter of public record, having been minuted in one of the many applications to the Secretary of State by the developer. It was disclosed by a planner and confirmed again by the council lawyers. No action has been taken.

Any criminal charges would be against the developer. It would be for a judge to determine guilt. Planners are only subject to the stress that such a situation has evoked. Hiding the facts is not in itself a crime: but nor is exposing them.

You should be very careful about relying on any planning officer either knowing or caring enough to reject a plan even one that breaches many of the council`s own rules. If your information comes from planners, they are not telling the truth. Council lawyers have stopped it and agreed to pay damages but are still quibbling about £200, and pleading poverty. The Africans are a white from South Africa and two blacks from west Africa.
