Re: Neighbour disputing boundary

What this means in simple english is that if this ever gets to court, the District Judge is likely to throw it out, with your costs paid by the owner. It is possible, if the judge likes you, that you would even get a small extra payment for the nuisance that has been caused to you o. Unfortunately i...

Re: Are conservation areas of any real use, anywhere?

Attacks by developers in conservation areas almost always involve the destruction of mature trees. Many developers and planners conceal this in their plans.

The National Trust has weighed in on changes to planning laws which will make trees still more vulnerable to developers.

Re: Neighbour disputing boundary

A renter has no business disputing the boundary. I suggest that you write to the owner with a copy of the deeds or any other evidence that you may have and ask him to stop her.

Re: Are conservation areas of any real use, anywhere?

Some councils do stop developers from increasing the height of buildings in conservation areas. An Indian-owned Victorian building converted into flats was stopped from adding anouther 3m above. It was already higher than its neighbours. Its basement once boasted a Romanian brothel. You could see th...

Re: Neighbour storing logs on access pathway

The estate agent owes you a favour. Ask for confirmation that no logs were stored on your land when you were taken there and that the right to do so was not in any of the ales documents. Ask them to check with the seller, whether he had such an arrangement. If not, get this documented. It will put y...

Re: Neighbour storing logs on access pathway

If the situation is as described, I would urge you to employ someone to move the logs, having explained the situation and obtained a quote from a strong labourer. You must be prepared for a forceful reaction if you have written to the neighbour politely, given him 7 days and he has not reacted. You ...

Re: Are conservation areas of any real use, anywhere?

This thread is about conservation or the lack of it. There is already far too much on another thread about a developer and the man that he threatened to decapitate trying to push through slum accommodation. I will not add to it here. The developer has removed six lines of bricks from a famous artist...

Re: Damp proof course - whose responsibility?

That would seem to be a very sensible approach to what might otherwise become expensive litigation, with no certain outcome. As I understand it you have done nothing to raise the land on your side of the fence and the neighbour has built a property illegally too close to your land possibly without a...

Re: Restrictive Covenants - working from home/eBay shop

Some council employees in both planning and enforcement are ignorant. Many more are lazy. The covenant has nothing whatsoever to do with them. Your usage of your home can in no way be described as business. It is most unlikely that you will hear anything more. The lesson here for others, is never ra...

Re: Parking question

You are correct that only your neighbour has the right to park on your land. Your fears are almost certainly also justified. Planning permission for let accommodation would normally assess the impact on parking. You need to talk to your other neighbours and your local ward councillor. When the plann...

Re: Beware of the Dog ....?

Unfortunately the law has become very harsh towards dogs after some well-publicised incidents of dogs breaking through hedges and killing people. If this were to happen, you would be liable and could face a prison term. A notice warning of dangerous dog would mitigate the severity of any legal actio...

Re: Are conservation areas of any real use, anywhere?

Thanks for the idea and sympathy. We did, but received the unhelpful reply that there were too many artists studios in the area. None, of course, belonged to someone this famous. Blue plaques also failed although nearby there are ones for Mahatma Gandhi and Geoffrey de Havilland.

has anyone seen Section 70a used with success

Has anyone heard of a successful used of Section 70a of the 1990 Town and Country Planning Act? To remind readers, this was introduced after Tesco had developed a practice of deluging LPA`s with repeated applications for stores and store extensions. It reads, in part,” where an application is simila...

Are conservation areas of any real use, anywhere?

Do conservation areas ever work? In our part of London, conservation mainly comes down to trees and green spaces, both of which are rare and under continuous threat from developers. The Council has a conservation officer, but he has never been heard to defend anything. Most of the recent planning ap...
