My goodness, all I asked was, are farmers liable to contain their stock. Anyway, back at the range, he's accepted responsability and is going to rectify the problem.

Farmers stock damaging fence.

My sister's garden bounds a farmers field in which he grazes his cattle. Unfortunately on a regular basis they lean over her fence to munch her plants, damaging the fence in the process. This has happened on a couple of other occasions and she has asked my help in determining who is responsable for ...

Leylandii and other evergreen trees and shrubs always lay you open to high hedge complaints. Was only joking about the leylandii, I'm not too bothered about replacing the tree, but interesting info about the bamboos, thank you.

Good that it's ended amicably but like I said he's got what he wanted. Game set and match. I know, but two strikes and it will be a different outcome, but in the meantime it's just a matter of gritting my teeth, neighbours, don't ya just luv 'em.

My neighbour acknowledges his gardener reduced my tree, but did it because he, the gardener, was maintaining the hedge, although he did admit the new plantings will get more sunshine. He promised no more cutting beyond the boundary fence, we shook hands and parted on amicable terms. Thank you all ag...

Even if he says the gardener did not follow instructions, the gardener was his contracted agent I wouldn't consider going down the legal route, I was interested to learn just what the position was, thank you for your reply, appreciated.

As to motivation, I am guessing that the OP's house is south of the neighbour? He probably wants more sunlight let in to his side - and has now achieved that objective. Spot on Arsie, I am South of my neighbour, and if you look at the OP you can see he has newly planted shrubs.

..as 'mr sheen' keeps trying to tell you, he would then still have been within his rights to cut the branches back to the boundary . If only he had cut the small % that did overhang, no problem. you would then be left with a tree with two foot stumps hanging over the hedge - which would be much mor...

Since there was some encroaching beyond your boundary he had the right to cut back to the boundary...it is now in dispute the % he cut back and any on your side or not. 0% outside your boundary would have meant he had no right to touch it but since it had some encroachment on his side he had a righ...
