Re: First Tier Property Tribunal

Thank you that's helpful.

We aren't going to go to Tribunal now, we have made a good statement of case thus far and yes we would have been available for witness statements.

Re: Occupying land

The wording was 'undocumented possessory title' which is just wonderful work on their solicitors behalf to be honest.

Re: Occupying land

Also, I should add that they have NOT applied for adverse possession, simply objected to our registration of it.

Their objection was based on their belief of having 'non paper possessory title' or some such nonsense, basically we want it without actually applying for it.

Re: Occupying land

To further update the thread... Further to them issuing a letter stating they would register the land to us, an objection was received, LR issued an option of compromise (us just having the pink land) this was refused too and objected to and now we are at Tribunal stage. I am told I can represent my...

Re: First Tier Property Tribunal

Would you believe me if I said no :D

Yes it is, as it's regarding Tribunal I thought a new thread may be in order.

First Tier Property Tribunal

I have requested to go to Tribunal after nearly a year of HMLR not being certain about anything apart from the fact that it is unregistered land. My question is, having read the attached, am I right in thinking that it is very unlikely that if unsuccessful, that I will be made to pay costs. I will j...

Re: Adverse possession query

I'm on the other side of this (Adverse Possession etc) so do let me know if you have any questions about how we've found it.
Best of luck.

Re: Occupying land

Just to update the thread really. I have been awarded the land and they are rectifying the title accordingly. Seemingly they have been advised against pursuing it via Adverse Possession, or it was outright rejected by LR - who knows. The key part, in my opinion, was excluding them from the land and ...

Re: Adverse possession query

As someone who is also concerned with boundaries on a strip of land. Pilman is right, it's not worth going to court for. But it is worth rectifying (if you realy feel you must and you want the land as outlined in your deeds) before the time elapses for a successful adverse possession claim. Let him ...

Re: Occupying land

I'm afraid your last post has only sowed further confusion in my mind. Looking at the map you posted on Friday 17th, there are 3 relevant lines here. the first runs north to south, and is at the eastern-most point. It encloses the pink land to the east. Let's call that line 1. The second line (line...

Re: Occupying land

Can you clarify, please: 1) "The line to the far right of the blue is the original legal physical boundary. A 150 year old wall." Legal physical boundary to WHAT - YOUR land? Yes and their garden As shown on your deeds? Is that plan taken from your DEEDS or the LR plan? Deeds. The LR plan ...

Re: Occupying land

If you own the land and have the title deeds why do need to show you are doing anything on it. Is the land registered. Unregistered. They missed off this part at first registration. Although we have to accept that the solicitors were told this, we don't think it was highlighted by LR in any meaning...
