Re: So WE Lost

I did heed their advice, in addition to photos we had two witnesses and two surveyors reports all saying that the boundary had been where it was previously for years We were never advised that we should go to the small claims court, our lawyers said that it should have been the courts who directed t...

So WE Lost

Briefly We have lived in the property many years, since the 60s, the boundary fences were always the same but a few years back we got new neighbours who decided to move the fence up to 3 ft into our garden, some of it on land that previously did not belong to her The woman would not cooperate with u...

Re: Adverse Possession Proof

You seriously need to heed the legal advice of your solicitor; it is not for you to tell a defendant what to do. YOu have lost me! Sorry, who is telling the defendant what? All I am asking is if the defendant has no proof is it possible to avoid full trail and bring a motion to the court to have a ...

Re: Adverse Possession Proof

The question wasn't really about the boundary butt get your point our house faces east, the neighbour to the west moved the fence about a meter into our garden for around 2 meters in length. the fence with our north facing neighbour runs straight from east to west but should run at an angle towards ...

Re: Adverse Possession Proof

PS We are in dispute with another neighbour, the adverse possession is to do with another neighbour that came to light when the fence was moved

Re: Adverse Possession Proof

Thanks, Can I ask a question, it is now 5 years since the neighbour moved the fence, we have provided plenty of proof that the boundary should be where it previously was. In her defense paper she goes on about us moving the fence first but encloses no proof, in disclosure she writes a lot lies, that...

Adverse Possession Proof

Our fence with our neighbors fence on the reg plans runs at an angle but in reality runs straight. The owners of the land say they won't contest any adverse possession claim and we have a few photos that show the fence it its current possession for the last 30 years or so and a couple of witnesses t...

Re: do I cut my neighbours side of my hedge?

Rightly or not I always cut the top of the hedges, although not sure whether it is there's, our or half . Some people on the road just cut to the half way point and if the neighbour does not cut it in a few years time you will need God to lean out from haven and do the job as they can get really high

Re: Court

No despair sadly not, I did try and press our first solicitor into getting an injunction but she said it was not possible, she said because they now have possesion we need to prove entitlment. Don't know much about land law but I know if it was a car or other posession with the proof we had, maps, p...

Re: Court

We prevented them from moving the fence on several occasions, even the police (who were called when the works moving the fence started to threaten use) told them not to move the fence, but in the end they suceeded when we were away, so if we move the fence back the probability is they will just move...

Court

Does anyone know the cost of going to court over a boundry dispute? We have what I think is a very simple case where a neighbour moved a boundary that was in the same place for the last 60 years and the land registary plans support the old boundary. Our neighbour claims her deeds are different to th...

Not really sure how property law differs from normal law, i know a contract needs to be signed before it is valid Not quite , a contract can still exist and be binding on the parties without anything being signed. Except for a few exceptions under contract law a verbal contract carries as much lega...

Thanks Sudynim Not really sure how property law differs from normal law, i know a contract needs to be signed before it is valid I would have thought that because our neighbour is the one who moved the fence she would be the one who needs to come up with proof/surveys reports and so on not sure why ...
