No ...tell them in no uncertain terms the posts are yours as is the fence and they cannot paint or stain it or attach anything whatever to it or grow ivy or climbers up it

What they have done is equivalent to you attaching stuff to his car ..,ask him what he would do if you did that

None of this makes any sense If the neighbour thought he owbed the land he must have had chance to tell the Land Registry If his land us lower than yours i cannot see how he can possibly own it since you are supposed to fence to fullest extent of your land But without a plan or photos i doubt anyone...

I hope it wont cometo needing to use your legal cover but sometimes sadly neighbours who take liberties like this are exceptionally reluctant to back down Its wrong to say that a polite letter is escalating the dispute its simply setting out the facts Do be very sure to keep a diary of chats etc ......

I repeat again ...he has put those posts on your land because he was too bone idle to dig out old posts foundations and it was easier while you were away to put them in your flower beds ....i would personally dig my heels in and tell him in no uncertain terms to move them ...back if front of his fen...

I have told you why he has put the posts on your land and that legally the podts and panels become yours as whats on the land goes with the land Whatever you decide to do draw up a document 2 copies detailing what has been agreed and get it signed and by all parties and witnessed by someone impartia...

I find the attitude of some of those who bought homes at a heavy discount which millions of other taxpayers have not benefitted from quite astounding

If all the OP has to give the council is 1/3 of their gains its even more unfair on taxpayers

If what a neighbour grows in their garden causes problems and invades your garden then it sure does become a problem

Constant cutting back branches and roots and clearing up leaves etc is costly

He will have done it that way becsuse he was too laxy to dig out the old concrete bases and took line of least resistsnce while you were away

The vendor of your house was required to state who owned what in the SPIF and your solicitor was responsible for checking such details and giving you a copy of the deeds
