Re: No boundary between neighbour's annexe and my garden

Sounds more like the vendor of your house merely gave permission for the windows and has generously allowed access for maintenance ...permission given is also permission denied .....you need to be sure of exactly what happened ....

Re: Dogs, fences and boundaries!

If you do replace the fence be very very sure that in writing and keeping copies that the next door agent landlord and tenants are strongly warned its your fence (installed under protest solely to protect your tenant and child from the dog which isactually legally the responsibility of their dog own...

Re: Dogs, fences and boundaries!

Sorry but the new tenant next door has a dog ...it is their full and total responsibilty to retain their own dog I would tell your agent this in no uncertain terms and as for your tree so long as its roots are not causing issues your not forced to do anything to apease this new bully tenant next door

Re: Prescription Act 1832

I believe that if you have used and tended the area uninterupted over the course of 20 years and a day then you have prescriptive rights ....

Its possible there may be caveats to this ...you will need advice from a specialist land solicitor not just any old solicitor

Re: Prescription Act 1832

Hello We live at the end of a cul-de-sac and opposite is another property. There is an undetermined boundary between the two properties which is open plan. Our garden butts up against our neighbours driveway. We have maintained the land up to our neighbours driveway for 33 years without interruptio...

Re: Subsidence

Janey ...i know exactly the kind of neighbours your dealing with and i would not give an inch .....insist right up front that you want a deposit held by your solicitor to cover all the costs of rectification because the neighbours have proved already to show no consideration for you and used your fi...

Re: Speeding on Right of Way

Well if they injure some poor resident in their current speeding disregard for life its likely to cost the poor resident a lot more in terms of long term disability than it will cost these ignorant oafs who may well not even be insured

Re: Maximun fence height with neighbours raised patio

I noticed today that Wickes had planters with a trellis back for £18 However i think liveinpeace idea of using decking boards to make a planter is great and B and Q will even cut things to length for you so then you only need hammer and nails to knock up something suitable ....sure one of your frien...

Re: Maximun fence height with neighbours raised patio

Re: Maximun fence height with neighbours raised patio

Yes Live InPeace has a good point ...if you plant tall bamboo in long slim planters and install tall posts with fancy trellis up high between the posts you will have your screen and your neighbour can do nothinhg ....as for the hedge why not cut it right back to the stems and install a 2 metre fence...

Re: Maximun fence height with neighbours raised patio

Did the neighbour get planning permision for his raised patio? Because he should have Is it supported by a proper retaining wall ? Or is the fence supporting it ? Because water run off will rot the fence Because many planners IMHE are unlikely to worry about you installing a fence higher than 2 metr...

Re: Painting of garden fence

I do not think scottish law on this is different ...if a wire fence is the boundary and your wood fence is your side of it then they had absolutely no right whatever to touch it let alone paint it or do so in such a way that it comes through There has been court cases reclaiming the cost of restorin...
