cost of obtaining a VEHICULAR Right Of Way along back alley

I find it frustrating when contributing to a thread and then the original poster goes silent, so we never learn the outcome of their dilemma. So here is the "closure" for this thread and the one that preceded it. https://www.gardenlaw.co.uk/phpBB2/viewtopic.php?f=8&t=20132 The basic dilemma was maki...

Re: cost of obtaining a VEHICULAR Right Of Way along back al

Hi John, The Highway Authority now has a whole raft of powers, especially when the Highway is a classified road, which this is. How well they are enforced is another matter and varies as does the local interpretation of the guidance from authority to authority. I have already ascertained that the Co...

Re: They need to stop building on flood plains then

In case you missed it last night: http://www.itv.com/news/2016-01-14/floods-are-we-ready-for-the-future-tonight/ " What we’ve seen is the warmest December on record and what’s interesting is that we’ve broke the record by 2 degrees - this is the consequences of one degree of warming that’s caused by...

Re: Can you split/divide a Prescriptive Right?

When I say gated the back lane, It could still be used to access the two flats but it could no longer be used as anything better than an unofficial bridleway. No longer any thru access for vehicles. The original "residence" had already sold off its "front" paddocks, on each side of an access avenue,...

Re: Can you split/divide a Prescriptive Right?

Have we got the name and address of the owner of this track ? Near me an early Victorian gentleman's residence was bought by an accountant and a contractor, who first subdivided it into a flat each. They then established a right of way to its back lane, and gated the back lane. Presumably nobody cam...

Re: cost of obtaining a VEHICULAR Right Of Way along back al

The council came to own the alley, as they bought the properties to use as Council Houses. [More accurately they bought some land on which to build some council houses post WW2, they got a terrace of early Victorian houses as part of the job lot.] The fellow at the the other end of the terrace parks...

Re: cost of obtaining a VEHICULAR Right Of Way along back al

Hi, If you neighbour can park in the alley without comment from the LA, then you should be able to to. Even better if you can park off the alley. I assume there is nothing in your deeds to prevent you removing your back fence/ And the council do not own the fence? Just do it, let the LA make the ru...

Why cannot the country feed itself ?

The balance of imports and exports depends on how one measures it. You will remember the Turkey Twizzler and disease import fuss that revealed that bootiful Norfolk turkeys were being processed in Eastern Europe and re-imported, because there was a market over there for the offal? A quick Google rev...

Re: They need to stop building on flood plains then

This thread started with a suggestion that the rate of housebuilding was acerbating the problem and this rate was driven by migration. My research suggests that the last annual figures showed a population increase of over 400,000 a mixture of immigration and births to foreign women. I was at a publi...

cost of obtaining a VEHICULAR Right Of Way along back alley

Five properties with a back fence between their gardens and a local council owned "back alley". The back alley is not public highway. These homes tend to have garden gates allowing them access to the alley but I would be the first to obtain a vehicular easement to park in the back garden. This would...

Re: Garden walk through.

It's an old building, It's like this, 4 houses (space)4 houses(space) And so the space is for letting people walk to their back doors. No one uses the walking path for anything anymore. I put a fence across; because I am 3/4 which means I use the right side to access the street from the path. So th...

Re: Rural rights of way and the arrival of the motor car.

Hi Mac, I am trying to buy the place BUT it is adverstised as having parking for 3 cars. I am 99% certain that the access onto the "C" road (or is it onto the back lane) has no planning permission from the County and/or no right of way especially with horses and carts onto the back lane owned by the...

The Higway Authority defines its position & costs.

Frustrated by the lack of support from the County Council Highways Department; at the weekend I had another poke about in their web site. First I found a massive down load of thousands of street names giving the parish name the county reference the status A, B, C, and unclassified. Ownership (ie it ...
