Re: Flooding from neighbours attenuation tank

I think that usually what happens is that the private company builds the academy - like Carillion or similar companies - and then the council rents the building off them (but as a fully serviced and managed package) to run their school. Under the old ways of doing things, schools were always owned a...

Re: Hut tubs and inflatable spas

Ah well, I suppose that I had better admit that I bought on earlier this week. Just a cheapy inflatable. Used it yesterday and it is lovely. I had done all the chemistry bit that you have to do as well. But as Treeman thinks....it might be a one hit wonder  And my neighbours will probably moan....

Re: garden shed against neighbours wall

I think no, he doesn't have right to ask you to move it. The shed is wholly in your garden and you can keep the shed there. Just ignore him or tell him that there is a gap so it couldn't be the shed causing the problem and see where it goes. For me it is a bit unfair that he wants to dictate how you...

Re: A complex case!!!!!!!!!

Also.....I wouldn't be so quick though to go and see a solicitor. You starting point should be that the neighbour haven't proved their case to your satisfaction and until they do, they can't have access to your drive. Then leave them to decide whether it is worth pursuing, they might decide that it ...

Re: Neighbours, Overhang – and the Disposal of Cut-off Branc

Yes, that is a good point Treeman about the costs to dispose of. My defence....I relied on Lemon V Webb to prove that I could cut back to boundary, I then relied on the 1919 case that the offcut belonged to the neighbour...I don't speak to the neighbour (a mutual thing) so I could not have entered i...

Re: Neighbours, Overhang – and the Disposal of Cut-off Branc

Sorry to go on and I know that we have had this discussion before. It isn't 'picking' on anyone I promise and I know that lots of you have a different opinion to me and Treeman on this one. And one last stab at this :) The problem that I have, as I said earlier....the law support two things. 1. that...

Re: Neighbours, Overhang – and the Disposal of Cut-off Branc

I agree Will and although I think that someone has mentioned fly tipping on here previously and I don't think that it is. I didn't think fly tipping applied to be privately owned land (although always happy to be corrected). Obviously as mentioned earlier - could have been another thread mind - the ...

Re: Neighbours, Overhang – and the Disposal of Cut-off Branc

Most law relating to this area is based on case law and will always be a bit grey I imagine. It is clear from the case law so far that you can cut to the boundary and that the cuttings belong to the tree owner. Everything else is grey. I had a row with my neighbours about this after I cut off overha...

Re: Bonfires near public footpath?

I am not sure that the fly tipping laws apply to private land? I am happy to be put right though. (I think that it was a thread about someone throwing cig butts over into the neighbours garden)

Re: Who is responsible for pruning trees - Landlord or Tenan

 I don't think ours say either way. If the tree needs cutting because it just gets on the tenants nerves, they would pay themselves. But say the tree was damaging a property we would remove at our own expense. I think that I just took it to be a run of the mill assured tenancy?

Re: Neighbours right of access through courtyard +Plant pots

Yes, I would agree with that. It is about getting ownership back effectively. Are they aware though of the situation? My neighbours have a ROW across my drive but treated like an extension to their house. When I confronted them, they thought that the land was shared between us. I have to give them a...
