There is no legal obligation for you to have a fence unless it would be dangerous not to. That would be if you stored dangerous chemicals in your garden or kept livestock, for example. So if you just have a normal everday common garden then no, you don't have to provide a fence.

In that case then there won't be any defined legislation that would apply nor would I think any case law so she will have to suck it and see?

Judges look for reasonable behaviour/actions while taking steps to avoid nuisance/tresspass and so in my opinion it would be unreasonable to remove.

Who can say that the line isn't part of the fence. They could argue, maybe, that the washing line is part of the fence support. Who says what materials should form a fence? They could also cut a grove in the post for the washing line to fit in snugly? My feeling is that common sense has been lost on...
