Re: Vehicular ROW dispute - claim of false deeds!

There is one final question that needs to be answered. Was the plan, which was the first one posted on this thread with the brown shading hand-drawn on it, a true copy of the original plan that was used with the Transfer Deed dated 18th January 1985. If it was then it ought to be a way to resolve th...

Re: running services to garden across/over neighbours pathway.

The previous response assumes that there is no power socket on the inside of the wall that faces the garden. That will require a hole to be drilled through the wall so that a cable can be laid to the out-building that requires power and lighting. Let's not over think the supply of power to an out-bu...

Re: running services to garden across/over neighbours pathway.

Of the three the power is my priority but want to avoid the expense of having a new supply installed from the public road if it can be helped. Most people arrange to connect electricity from the existing house supply in order to feed power to a garden out-building, so why do you think it will it be...

Re: Vehicular ROW dispute - claim of false deeds!

I have just realised that I may have posted some confusing comments earlier, because it seems that a printed TP1 form was not used for the transfers. The posted extracts from the official copies provided by Land Registry show that in this instance the solicitor acting for the Developer drafted his o...

Re: Vehicular ROW dispute - claim of false deeds!

I think that when the three title plans for 2, 3 & 4 were issued by Land Registry it used a version of the OS map that had recently been revised to show the position of the parking bays that could be identified when that latest survey had been completed. The title plan used for No.1 would have been ...

Re: Vehicular ROW dispute - claim of false deeds!

I've just had a look at all four of the Property Registers and they all say the same thing. Under section A: Property register 1. the date shown is 14.05.1984 Is this the date that the entire site was registered before it was divided up into 4 plots? I think it is. Does this have implications? When...

Re: Our building work, rights of way and neighbours

The National Trust wants us to sign something saying we will repair the track whenever they want during the build to whatever the standard they want. Just to confirm how the common law deals with the maintenance of a right of way as set out in the case of Carter v Cole. Carter v. Cole (2006) - Cour...

Re: Vehicular ROW dispute - claim of false deeds!

Recently I came across a conveyance dated April 1986, although letters sent from one solicitor to the other solicitor continued to be sent until the one dated March 1987 confirmed that an engrossed copy of the Conveyance had been sent after agreeing all the terms of the Conveyance. What happened the...

Re: Gates on footpaths

In earlier parts of this thread there was a mention of the Definitive Map, but no mention of what was written in the Definitive Statement. If there was a defined width allocated to this particular public footpath then this would be seen in the statement. The definitive map and statement was introduc...

Re: Vehicular ROW dispute - claim of false deeds!

You need to read the whole of both of the TP1 deeds to see what was referred to about the areas tinted in colour on each of those deed plans. You can verify what was the date written on each of the TP1 deeds to confirm which property was sold first. You can confirm that there was a reserved right of...

Re: Gates on footpaths

A change of use of land from agricultural use to use as part of a residential garden is immune from enforcement action by the local planning authority after 10 years. It then becomes the lawful use of the land, although the public right of way cannot be disturbed. Since it is very common for highway...

Re: Use Dominant owned land in part to supply the Right of Way?

A right of way for the purchasers and all persons authorised by them with or without vehicles over the land shown coloured blue on plan A That area coloured blue does not appear on the plans posted so it is not clear which area of land was to be the right of way. Was it just the area which is shown...

Re: Gates on footpaths

In Central Bedfordshire where I live it is quite common to see kissing gates at each end of a public footpath that passes over land which is directly accessed from the public carriageway which has no footpath alongside it where it runs from the village alongside the fields on each side of the road. ...

Re: General binding rules: GBR small sewage discharge to a surface water

Hi Mugwump, that is not something I gave any thought to, so probably best that the new company owner asks the last owner to look after the land for him by maintaining the land in a weed free condition. No rent, just an informal arrangement so that the company can remain dormant. If the initial share...
