So far so good under difficult circumstances. I am slightly surprised your insurers are agreeing to pay as I thought they always have exclusion clauses e.g. not in the first six months/one year. As a matter of interest were the trees already there when he built his garage? That might explain the app...

The OP has not posted since day 1 (September 5). It would be interesting to hear what has happened since, if anything. Small and petty though this problem may seem to some, it is nevertheless highly annoying if it happens to you, as modern-day inconsiderate actions often can be, sadly.

Under 'permitted development' the shed if it was built today would break the rules on combustible materials and distance, as it is made of wood and less than 1 metre from a neighbour's house (and possibly on height too; although you have not said how high it is.) Sure you can do it, but this will be the last time you will be able to get at the gap so make sure there are no rat encampments or worse in there! Personally I would not build so close but maybe space is v limited.

janie, could it be your council are having problems with their web site? ;) If you looked last week you could personally bear witness to/remember the conditions. And if some insider has deleted it, there should be an audit trail of changes on their system, especially if it was there only a week ago....
