Personally getting something in writing RE you ROW will be critical as you will always in the back of your mind know it can come back.
Now that they seem to be capitulating I would push for it.

I have followed this from the start and I tend to agree. By allowing the fence to remain it seems you have acquiesced. Sounds absurd! My gut feel tells me that the process of law cannot be stopped if someone has gone on holiday...
Would it be lunacy to remove said fence since he is away?
