Re: Complete row of townhouses with out of sync boundaries

Am I right in thinking that if other neighbours have already breached a covenant but having hedges between the two terraced properties, that it is less likely that I could be sued for breach of covenant? I double checked my deeds again and there is a paragraph about being obliged to maintain fences ...

Re: Complete row of townhouses with out of sync boundaries

Looking at the driveways, there is a very definite defining line or slight crack between each property and that is not in line with what I think the boundary would be when looking at the houses. Are there any manholes in the vicinity of the boundary?.............one explanation of any apparent disc...

Re: restrictive covenants and fences

I hear what you are saying but I am new to this forum and it isn't unreasonable to assume that there can be different issues deserving of different threads. But, yes, I shall go back (as suggested).

Re: restrictive covenants and fences

I shall quote the first part of the document to clarify this: "The transferee so as to bind the land hereby transferred into whosoever hands the same may come and so that this covenant may be for the benefit and protection of each and every part of the Estate hereby covenants with the Transferor tha...

Re: restrictive covenants and fences

Thank you all for your responses. No other neighbours have put up fences between the properties although there is the odd hedge. It is mostly open plan (as was the intention presumably). Due to bad feeling with the neighbour, we don't want to risk breaking a covenant, having them sue and then have t...

Re: restrictive covenants and fences

When I posted the original thread I had no idea about the restrictive covenant not allowing fencing. I then saw the actual document in detail and realised about the restrictions. So not exactly multi posting and not the same problem at all. If you care to look back, the original thread was about som...

Re: Put the tape measure away

What an interesting thread! A lot to digest but such useful information. I was freaking out a bit because it appeared that my NFH neighbours may have owned part of my front garden since if the boundary was to be measured as I have read it should be measured - between the two front windows of the tow...

restrictive covenants and fences

I discovered that I have a restrictive covenant that bans me from erecting fencing between my terraced house and the house next door. We have had issues with a neighbour and currently his bins are lined up in such a way that we face three bins each time we leave our house. We are anxious to screen t...

Pilman

Thank you so much for that detailed information. My mind is more at rest now. Very much appreciated.

Re: Complete row of townhouses with out of sync boundaries

Hi Mac If you were to stand in front of my house, to the left is my single driveway and to the right is my garden. Looking at the houses, I am being told that the boundary is the midway point between the two main windows plus every other house has a down water pipe midway between the houses. If this...

Re: Complete row of townhouses with out of sync boundaries

I have just applied for the restrictive covenant document which will clarify what I am allowed to do.

I realise I am over-thinking this but need to pre-empt any possible issues before going ahead.

Thank you again for your responses.

Re: Complete row of townhouses with out of sync boundaries

There are no existing fences between the row of townhouses and no fences between any of the terraced houses opposite, just low walls going as high as 5 bricks. That made me think there were certain rules individual to this estate. I wanted clarification that we can put up a low fence and build it up...

Re: Complete row of townhouses with out of sync boundaries

Ah, I see (and thank you again for your responses). Viewing the area on the ground and each individual property (and I have looked closely at all the houses) there is a definite demarcation line in the front drives which appears to divide each property and put the boundary where I thought it was ori...

Re: Complete row of townhouses with out of sync boundaries

Thank you for your responses. Re adverse possession, I believe we had to be using the land as our own for 13 years prior to a change in law in 2003. We missed out on that by one year :( We had the house from 1992. If we get the go-ahead from the local council we will erect a low fence and possibly r...

Re: Complete row of townhouses with out of sync boundaries

The houses were built around 1969. The houses are all in line. We purchased the property around 25 years ago and nothing came up on the conveyancing. The property next door has changed hands at least four times in our time and no issues at all. I even spoke to my ex neighbour last week who sold last...
