Sorry, but I think Syckend has got it slightly wrong. Assuming that the road is a proper 'Highway' then I believe it's limits will be properly defined and cannot be extended by any useage, 20 years or otherwise. However, it is likely that this patch of land is in fact part of the highway already. So...

Where is all this water coming from? I guess your neighbour is using a hosepipe from a normal tap, which means the water company are losing a lot of water! I suggest you report a 'leak' to the water company.
