Extending existing shared boundary wall?

Post by Mr Hat » Tue May 01, 2018 5:05 pm

Wall was rebuilt sharing costs with neighbour and left it 1m short of the public footpath for ease of getting cars in driveway. I’d now like to extend back to footpath (it’s original dimensions) but neighbour claims I need their permission? Anyone know if this is correct?

If the wall straddles the boundary you will. If you are content for the extension to go up to but not beyond the boundary then you don't need their permission.

Were they given an implied easement to use the extra swing room (or have they acquired such by virtue of 20 years use)?
