Neighbour has blocked a water runoff.

We've got a drainage "ditch" along a path in the form of shaped cobbles that runs along a cobbled path downhill from our house and past 2 neighbours' houses. The lower of these neighbours appears to have concreted over the path including the drainage ditch. Water runs off from all of our roofs (we're thatched so have no gutters) and onto the path which is sloped into the drainage ditch and away down the path. Additionally, we have an old well which, I'm led to believe, could potentially overflow although this one isn't known to have done so. We're concerned that, should we get any particularly inclement weather and all this water run-off collects at the bottom where this other neighbour has concreted over it and causes a flood, is there any chance he can point fingers at us because it's 'our' water and hold us responsible for flooding his house?
